H.F. 588 Section 1. Section 321L.2, subsection 1, unnumbered 1 paragraph 1, Code 2019, is amended to read as follows: 2 A resident of the state with a disability desiring a persons 3 with disabilities parking permit shall apply to the department 4 upon an application form furnished by the department providing 5 the applicant’s full legal name, address, date of birth, and 6 social security number or Iowa driver’s license number or 7 Iowa nonoperator’s identification card number, and shall also 8 provide a statement from a physician licensed under chapter 9 148 or 149 , a physician assistant licensed under chapter 10 148C , an advanced registered nurse practitioner licensed 11 under chapter 152 , or a chiropractor licensed under chapter 12 151 , or a physician, physician assistant, nurse practitioner, 13 or chiropractor licensed to practice in a contiguous state, 14 written on the physician’s, physician assistant’s, nurse 15 practitioner’s, or chiropractor’s stationery, stating the 16 nature of the applicant’s disability and such additional 17 information as required by rules adopted by the department 18 under section 321L.8 . If the person is applying for a 19 temporary persons with disabilities parking permit, the 20 physician’s, physician assistant’s, nurse practitioner’s, or 21 chiropractor’s statement shall state the period of time during 22 which the person is expected to be disabled and the period 23 of time for which the permit should be issued, not to exceed 24 six months. The department may waive the requirement that 25 the applicant furnish the applicant’s social security number, 26 Iowa driver’s license number, or nonoperator’s identification 27 card number when the application for a temporary persons with 28 disabilities parking permit is made on behalf of a person 29 who is less than one year old. The department may accept a 30 certification of disability from the United States department 31 of veterans affairs in lieu of a statement from a physician, 32 physician assistant, advanced registered nurse practitioner, 33 or chiropractor. The department shall accept proof that the 34 person holds a persons with disabilities parking permit, or 35 -1- LSB 1954YH (3) 88 ns/rh 1/ 2
H.F. 588 a substantially similar permit, from another state, valid at 1 the time the person submits the application to the department, 2 in lieu of a statement from a physician, physician assistant, 3 advanced registered nurse practitioner, or chiropractor, 4 if the person became a resident of the state within the 5 sixty-day period prior to submitting the application. The 6 department may adopt rules pursuant to chapter 17A detailing 7 the requirements for an acceptable certification of disability 8 or the requirements for proof that a person holds a persons 9 with disabilities parking permit, or a substantially similar 10 permit, from another state . 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 Under current law, a resident of the state with a disability 15 desiring a persons with disabilities parking permit must 16 apply to the department of transportation (DOT) and provide 17 the applicant’s full legal name, address, date of birth, and 18 social security number or Iowa driver’s license number or 19 Iowa nonoperator’s identification card number, and must also 20 provide a statement from a physician, physician assistant, 21 advanced registered nurse practitioner, or chiropractor. This 22 bill requires the DOT to accept proof that the person holds a 23 persons with disabilities parking permit, or a substantially 24 similar permit, from another state, valid at the time the 25 person submits the application to the DOT, in lieu of a 26 statement from a physician, physician assistant, advanced 27 registered nurse practitioner, or chiropractor, if the person 28 became a resident of the state within the 60-day period prior 29 to submitting the application. 30 -2- LSB 1954YH (3) 88 ns/rh 2/ 2
