Section 29C.8, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 6. The director may establish permanent 1 4 emergency personnel positions that are directly related to the 1 5 governor's proclamation of a state of disaster emergency or 1 6 when the president of the United States has declared a major 1 7 disaster to exist in this state. All such emergency personnel 1 8 shall be exempt from the merit system described in chapter 8A, 1 9 subchapter IV, and shall be excluded from collective bargaining 1 10 as described in chapter 20. All such emergency personnel shall 1 11 be classified, compensated, and eligible to receive benefits in 1 12 accordance with chapter 8A, subchapter IV. 1 13 EXPLANATION 1 14 The inclusion of this explanation does not constitute agreement with 1 15 the explanation's substance by the members of the general assembly. 1 16 This bill provides that the director of the department 1 17 of homeland security and emergency management may establish 1 18 permanent emergency personnel positions that are directly 1 19 related to the governor's proclamation of a state of disaster 1 20 emergency or when the president of the United States has 1 21 declared a major disaster to exist in this state. The bill 1 22 provides that all such emergency personnel shall be exempt 1 23 from the merit system as provided in Code chapter 8A and 1 24 excluded from collective bargaining under Code chapter 20. The 1 25 bill further provides that such emergency personnel shall be 1 26 classified, compensated, and eligible to receive benefits in 1 27 accordance with Code chapter 8A.
