Restriction
of
prescribing
1
authority
by
board.

1.
Any
board
created
under
this
chapter
that
licenses
a
3
prescribing
practitioner
shall
not
restrict
the
prescribing
4
authority
of
a
prescribing
practitioner
during
a
public
health
5
disaster
in
a
way
that
acts
as
a
deterrent
for
a
prescribing
6
practitioner
to
use
a
medication
or
treatment
in
accordance
7
with
the
prescribing
practitioner’s
best
professional
judgment.

For
purposes
of
this
section:
9
a.
“Prescribing
practitioner”
means
the
same
as
defined
in
10
section
147.162.

b.
“Public
health
disaster”
means
the
same
as
defined
in
12
section
135.140.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
any
health-related
professional
board
17
under
Code
chapter
147
(general
provisions,
health-related
18
professions)
that
licenses
a
prescribing
practitioner
from
19
restricting
the
prescribing
authority
of
a
prescribing
20
practitioner
during
a
public
health
disaster
in
a
way
that
21
acts
as
a
deterrent
for
the
practitioner
to
use
a
medication
22
or
treatment
in
accordance
with
the
practitioner’s
best
23
professional
judgment.
The
bill
defines
“prescribing
24
practitioner”
and
“public
health
disaster”
for
the
purposes
of
25
the
bill.
