H.F. 536 Section 1. Section 692A.101, subsection 1, paragraph a, 1 subparagraph (5), Code 2021, is amended to read as follows: 2 (5) Assault with intent to commit sexual abuse in violation 3 of section 709.11 , subsection (1) or (2) . 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 Under current law, convictions for certain criminal 8 offenses, including assault with intent to commit sexual abuse 9 pursuant to Code section 709.11 regardless of the circumstances 10 of the offense, are defined as “aggravated offenses” for 11 purposes of the sex offender registry. Upon conviction of an 12 aggravated offense, a sex offender is required to register with 13 the sex offender registry for life. 14 This bill amends the definition of an “aggravated offense” 15 to exclude persons convicted of assault with intent to commit 16 sexual abuse where there is no resulting injury. 17 -1- LSB 2707YH (2) 89 as/rh 1/ 1
