H.F. 479 Section 1. Section 152C.5, Code 2019, is amended to read as 1 follows: 2 152C.5 Practice or use of title —— license required. 3 The practice of massage therapy as defined in section 4 152C.1 is strictly prohibited by unlicensed individuals. It 5 is unlawful a serious misdemeanor for a person to engage in or 6 offer to engage in the practice of massage therapy, or use in 7 connection with the person’s name, the initials “L. M. T.” or 8 the words “licensed massage therapist”, “massage therapist”, 9 “masseur”, “masseuse”, or any other word or title that implies 10 or represents that the person practices massage therapy, unless 11 the person possesses a license issued under the provisions of 12 section 152C.3 . 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill makes the practice of massage therapy or the use 17 of titles associated with massage therapists by an unlicensed 18 individual a serious misdemeanor. A serious misdemeanor is 19 punishable by confinement for no more than one year and a fine 20 of at least $315 but not more than $1,875. 21 -1- LSB 1644HV (2) 88 ss/rn 1/ 1
