  1  1    Section 1.  NEW SECTION.  103A.8D  Residential construction
  1  2 requirements and standards for radon control.
  1  3    The state building code commissioner shall adopt as a part
  1  4 of the state building code construction requirements and
  1  5 standards for radon control in new residential construction.
  1  6 The requirements and standards adopted by the commissioner
  1  7 shall, if possible, be based upon a nationally recognized
  1  8 standard or code for radon control in residential construction.
  1  9 Notwithstanding any other provision of this chapter to the
  1 10 contrary, the construction requirements and standards for radon
  1 11 control adopted by the commissioner and approved by the council
  1 12 shall apply to new residential construction commenced on or
  1 13 after January 1, 2017, and shall supersede and replace any
  1 14 minimum requirements and standards for radon control in new
  1 15 residential construction adopted or enacted by a governmental
  1 16 subdivision prior to that date.  The state building code
  1 17 commissioner may provide training to builders, contractors, and
  1 18 other interested persons on the construction requirements and
  1 19 standards for radon control in residential construction.
  1 20    Sec. 2.  Section 103A.10, Code 2015, is amended by adding the
  1 21 following new subsection:
  1 22    NEW SUBSECTION.  6.  Notwithstanding any other provision of
  1 23 this chapter to the contrary, the construction requirements and
  1 24 standards for radon control in new residential construction
  1 25 adopted by the commissioner and approved by the council shall
  1 26 apply to all new residential construction commenced on or after
  1 27 January 1, 2017, and shall supersede and replace any minimum
  1 28 requirements or standards for radon control in new residential
  1 29 construction adopted or enacted by the governmental subdivision
  1 30 prior to that date.
  1 31                           EXPLANATION
  1 32 The inclusion of this explanation does not constitute agreement with
  1 33 the explanation's substance by the members of the general assembly.
  1 34    This bill requires that the building code commissioner,
  1 35 with the approval of the building code advisory council, adopt
  2  1 requirements and standards for radon control in new residential
  2  2 construction. The bill provides that the standards shall
  2  3 supersede and replace any minimum radon control requirements
  2  4 and standards for new residential construction adopted by
  2  5 governmental subdivisions in Iowa. The bill requires that the
  2  6 requirements and standards be mandatory for all new residential
  2  7 construction beginning on or after January 1, 2017.
  2  8    The bill makes penalties related to failure to comply
  2  9 with certain orders applicable under Code section 103A.19,
  2 10 subsection 2, paragraph "c", to the radon control requirements
  2 11 and standards. A knowing violation of the state building code
  2 12 or a lawful order is considered a simple misdemeanor under
  2 13 Code section 103A.21. A simple misdemeanor is punishable by
  2 14 confinement for no more than 30 days or a fine of at least $65
  2 15 but not more than $625 or by both.
