H.F. 469 Section 1. Section 279.50, subsection 2, Code 2019, is 1 amended to read as follows: 2 2. Each school board shall provide age-appropriate and 3 research-based instruction in human growth and development 4 including instruction regarding human sexuality, self-esteem, 5 stress management, interpersonal relationships and consent , 6 domestic abuse, HPV and the availability of a vaccine to 7 prevent HPV, and acquired immune deficiency syndrome as 8 required in section 256.11 , in grades one through twelve. 9 Sec. 2. Section 279.50, subsection 9, Code 2019, is amended 10 by adding the following new paragraph: 11 NEW PARAGRAPH . 0b. “Consent” means the unambiguous and 12 voluntary agreement between all participants in each physical 13 act within the course of interpersonal relationships, including 14 respect for personal boundaries. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill provides that age-appropriate and research-based 19 instruction in human growth and development, which each school 20 board must provide to students enrolled in grades 1-12, must 21 include instruction regarding consent, which is defined by 22 the bill as the unambiguous and voluntary agreement between 23 all participants in each physical act within the course of 24 interpersonal relationships, including respect for personal 25 boundaries. 26 -1- LSB 2205YH (2) 88 kh/jh 1/ 1
