Section
1.
Section
321J.2,
Code
2011,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
9A.
A
person
shall
receive
credit
for

the
time
the
person
was
subject
to
a
license
revocation
under
4
section
321J.9
or
321J.12
for
actions
arising
out
of
the
same
5
event
or
occurrence
that
led
to
the
defendant’s
subsequent
6
conviction
for
a
violation
of
this
section.

EXPLANATION

This
bill
allows
a
person
in
an
operating-while-intoxicated
9
case
who
is
subject
to
an
administrative
license
revocation
for
10
refusing
a
chemical
test
under
Code
section
321J.9
or
who
is
11
subject
to
a
license
revocation
for
failing
a
chemical
test
12
(indicating
the
presence
of
drugs
or
alcohol
above
the
legal
13
limit
pursuant
to
Code
section
321J.2)
under
Code
section
14
321J.12
to
receive
credit
for
the
time
the
person
was
subject
15
to
the
license
revocation
for
actions
arising
out
of
the
same
16
event
or
occurrence
that
led
to
the
defendant’s
subsequent
17
criminal
conviction
for
a
violation
of
Code
section
321J.2.
