Section 461A.42, subsection 1, paragraph b, Code 1 2 2015, is amended to read as follows: 1 3 b. A person may use a bow and arrow with an attached bow 1 4 fishing reel and ninety=pound minimum line attached to the 1 5 arrow to take catfish or rough fish as provided by rule of the 1 6 commission. 1 7 Sec. 2. Section 481A.76, Code 2015, is amended to read as 1 8 follows: 1 9 481A.76 Unlawful means == exception. 1 10 It is unlawful, except as otherwise provided, to use on or 1 11 in the waters of the state any grabhook, snaghook, any kind of 1 12 a net, seine, trap, firearm, dynamite, or other explosives, or 1 13 poisonous or stupefying substances, lime, ashes, electricity, 1 14 or hand fishing in the taking or attempting to take any fish, 1 15 except that gaffhooks or landing nets may be used to assist in 1 16 landing fish. The commission may permit designated fish to be 1 17 taken by hand fishing, by snagging, by spearing, by bow and 1 18 arrow, and with artificial light at the times and at the places 1 19 as determined by rules of the commission. The commission 1 20 shall permit the taking of catfish by bow and arrow, and with 1 21 artificial light in the manner and at the times and at the 1 22 places as determined by rules of the commission. 1 23 EXPLANATION 1 24 The inclusion of this explanation does not constitute agreement with 1 25 the explanation's substance by the members of the general assembly. 1 26 This bill allows a person to take catfish with a specified 1 27 bow and arrow in state parks and preserves as provided by rule 1 28 of the commission. A violation of this provision is punishable 1 29 with a scheduled fine of $50. The bill also requires the 1 30 natural resource commission to allow the taking of catfish by 1 31 means of bow and arrow and with artificial light in a manner 1 32 and at times and places as determined by the commission by 1 33 rule. A violation of this provision is punishable with a 1 34 scheduled fine of $50. 1 35 Currently, only the taking of rough fish in state parks 2 1 and preserves is allowed by use of a specified bow and arrow 2 2 as provided by rule of the commission, and the commission is 2 3 allowed, but not required, to designate fish that can be taken 2 4 by bow and arrow.
