Section 455B.103, subsection 4, unnumbered 1 2 paragraph 1, Code 2015, is amended to read as follows: 1 3 Conduct investigations of complaints received directly 1 4 or referred by the commission created in section 455A.6 or 1 5 other investigations deemed necessary. While conducting an 1 6 investigation, the director may enter at any reasonable time 1 7 in and upon any private or public property to investigate any 1 8 actual or possible violation of this chapter, chapter 459, 1 9 chapter 459A, chapter 459B, or the rules or standards adopted 1 10 under this chapter, chapter 459, chapter 459A, or chapter 1 11 459B. However, the owner or person in charge shall be notified 1 12 and allowed to be present and observe while the director 1 13 investigates any actual or possible violation on that property 1 14 or in the watershed of that property. 1 15 EXPLANATION 1 16 The inclusion of this explanation does not constitute agreement with 1 17 the explanation's substance by the members of the general assembly. 1 18 This bill allows a property owner or person in charge of 1 19 the property to be present and observe the director of the 1 20 department of natural resources or the director's designee 1 21 during an investigation into any actual or possible violation 1 22 on that property or in the watershed of that property.
