  1  1    Section 1.  Section 602.8109, subsection 1, Code 2017, is
  1  2 amended to read as follows:
  1  3    1.  A city or a county shall have the option to pay court
  1  4 costs and other fees payable to the clerk of the district
  1  5 court for services rendered upon receipt of a statement from
  1  6 the clerk disclosing the amount due. upon any of the following
  1  7 occurrences:
  1  8    a.  Upon the filing of a civil or criminal action or the
  1  9 rendering of court services that require the payment of a fee
  1 10 or costs.
  1 11    b.  Upon receipt of a statement from the clerk disclosing the
  1 12 amount due.
  1 13    c.  Upon entry of judgment in a civil or criminal case in
  1 14 district court if the city or county does not prevail in the
  1 15 civil or criminal case.
  1 16                           EXPLANATION
  1 17 The inclusion of this explanation does not constitute agreement with
  1 18 the explanation's substance by the members of the general assembly.
  1 19    This bill concerns the payment of court fees and other fees
  1 20 to the clerk of the district court by a city or county.
  1 21    The bill provides a city or county with the option to pay
  1 22 court costs or fees when the court filing requiring the payment
  1 23 occurs, upon receipt of a statement from the clerk disclosing
  1 24 the amount due, or upon adjudication of the civil or criminal
  1 25 case in district court if the city or county does not prevail
  1 26 in the civil or criminal case.  Current law provides that
  1 27 payment shall be made upon receipt of a statement from the
  1 28 clerk of the district court.
