  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 135C.6, Code 2017, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  11.  A nursing facility that is licensed
  1  4 and inspected as a food establishment pursuant to chapter
  1  5 137F shall not be required to obtain an additional license or
  1  6 submit to additional inspection in order to prepare meals to be
  1  7 delivered off=site by another entity.
  1  8    Sec. 2.  Section 231C.3, Code 2017, is amended by adding the
  1  9 following new subsection:
  1 10    NEW SUBSECTION.  5A.  An assisted living program that is
  1 11 licensed and inspected as a food establishment pursuant to
  1 12 chapter 137F shall not be required to obtain an additional
  1 13 license or submit to additional inspection in order to prepare
  1 14 meals to be delivered off=site by another entity.

  1 16 The inclusion of this explanation does not constitute agreement with
  1 17 the explanation's substance by the members of the general assembly.
  1 18    This bill provides that nursing facilities and assisted
  1 19 living programs that are licensed and inspected as a food
  1 20 establishment pursuant to Code chapter 137F do not need to hold
  1 21 another license or submit to additional inspection in order to
  1 22 prepare meals to be delivered off=site by another entity.
