Section
1.
Section
257.35,
subsection
1,
Code
2011,
is
1
amended
to
read
as
follows:

1.
The
For
school
budget
years
ending
prior
to
July
1,
3
2012,
the
department
of
management
shall
deduct
the
amounts
4
calculated
for
special
education
support
services,
media
5
services,
area
education
agency
teacher
salary
supplement
6
district
cost,
area
education
agency
professional
development
7
supplement
district
cost,
and
educational
services
for
each
8
school
district
from
the
state
aid
due
to
the
district
pursuant
9
to
this
chapter
and
shall
pay
the
amounts
to
the
respective
10
area
education
agencies
on
a
monthly
basis
from
September
15
11
through
June
15
during
each
school
year.
The
department
of
12
management
shall
notify
each
school
district
of
the
amount
13
of
state
aid
deducted
for
these
purposes
and
the
balance
of
14
state
aid
shall
be
paid
to
the
district.
If
a
district
does
15
not
qualify
for
state
aid
under
this
chapter
in
an
amount
16
sufficient
to
cover
its
amount
due
to
the
area
education
agency
17
as
calculated
by
the
department
of
management,
the
school
18
district
shall
pay
the
deficiency
to
the
area
education
agency
19
from
other
moneys
received
by
the
district,
on
a
quarterly
20
basis
during
each
school
year.

2.
NEW
SECTION
.
257.35A
Area
education
agencies
——

state
funding
redirected.

1.
Notwithstanding
any
provision
of
this
chapter
to
the
24
contrary,
for
school
budget
years
beginning
on
and
after
25
July
1,
2012,
the
state
aid
funding
for
special
education
26
support
services,
media
services,
and
educational
services,
27
as
calculated
by
this
chapter,
shall
be
paid
directly
to
the
28
applicable
school
district.

2.
A
school
district
receiving
funding
under
subsection
1
30
shall
choose
one
of
the
following
options:
31
a.
A
school
district
may
provide
its
own
special
education
32
services,
media
services,
and
educational
services,
as
those
33
services
are
described
in
chapter
273.
However,
the
school
34
district
shall
not
receive
funding
for
its
costs
that
exceeds
35

except
for
funds

received
from
another
school
district
for
providing
special

education
services,

services,
or

district
may
solicit
bids
from
public

organizations
and
private
organizations,
including
other
school
6
districts
and
area
education
agencies,
to
provide
special
7
education
services,
media
services,
and
educational
services,
8
as
those
services
are
described
in
chapter
273.
However,
the
9
school
district
soliciting
bids
shall
not
receive
funding
for
10
its
costs
that
exceeds
the
amount
determined
under
subsection
11
1.

The
department
of
education
shall
distribute
the
13
appropriate
amount
of
area
education
agency
professional
14
development
supplement
and
area
education
agency
teacher
salary
15
supplement
funding
to
a
school
district
if
an
area
education
16
agency
successfully
bids
to
provide
the
services.

3.
Section
273.9,
subsection
1,
Code
2011,
is
amended
18
to
read
as
follows:

1.
School
For
school
budget
years
ending

agency
and
shall
include

expenditures
for
the
programs
and
services
in
their
budgets,
in

accordance

this

manner
to
be
determined
by
the
department
of

education
by
rule
under
chapter
17A.

Sec.
5.
APPLICABILITY
DATE.
This
Act
applies
to
school
3
budget
years
beginning
on
and
after
July
1,
2012.

EXPLANATION
5
This
bill
enacts
new
Code
section
257.35A,
which
directs
6
state
aid
funding
for
special
education
support
services,
7
media
services,
educational
services,
area
education
agency
8
professional
development
supplement,
and
area
education
agency
9
teacher
salary
supplement
to
the
applicable
school
districts.
10
The
bill
allows
a
school
district
to
provide
its
own
11
services.
A
school
district
may
also
bid
to
provide
services
12
to
other
school
districts.
A
school
district
may
also
solicit
13
bids
from
certain
organizations
to
receive
these
services.
If
14
a
school
district
provides
its
own
special
education
support
15
services,
media
services,
or
educational
services,
it
shall
16
not
receive
funding
that
exceeds
the
amount
determined
under
17
new
Code
section
257.35A.
The
bill
requires
area
education
18
agencies
(AEAs)
and
other
organizations
to
bid
to
provide
19
special
education
support
services,
media
services,
and
20
educational
services.
An
AEA
or
organization
that
successfully
21
bids
to
provide
these
services
to
a
school
district
will
22
receive
the
appropriate
amount
of
funding
from
the
applicable
23
school
district.
The
department
of
education
is
tasked
with
24
developing
the
bid
process
by
rule.
25
Currently,
area
education
agency
funding
operates
pursuant
26
to
a
“flow-through”
concept.
With
no
direct
taxing
authority,
27
AEAs
rely
on
local
school
districts
to
generate
funds
for
their
28
operation.
While
AEA
funding
is
included
within
a
school
29
district’s
budget,
the
district
does
not
actually
receive
30
AEA-related
state
aid
payments.
Instead,
funds
generated
by
31
the
districts
through
the
operation
of
the
school
finance
32
formula
and
earmarked
for
AEAs
are
subtracted
by
the
department
33
of
management
from
the
state
aid
otherwise
due
to
the
district
34
and
are
paid
directly
to
each
AEA.
