Section
1.
TERMINATION
OF
MEDICAID
MANAGED
CARE
1
CONTRACTS
RELATIVE
TO
LONG-TERM
SERVICES
AND
SUPPORTS
AND
2
MEDICARE-MEDICAID
DUAL
ELIGIBLE
POPULATIONS
——
TRANSITION
TO
3
FEE-FOR-SERVICE.
The
department
of
human
services
shall,
upon
4
the
effective
date
of
this
Act,
provide
written
notice
in
5
accordance
with
the
termination
provisions
of
the
contract,
6
to
each
managed
care
organization
with
whom
the
department
7
executed
a
contract
to
administer
the
Iowa
high
quality
health
8
care
initiative
as
established
by
the
department,
to
terminate
9
such
contracts
as
applicable
to
the
Medicaid
long-term
10
services
and
supports
and
Medicare-Medicaid
dual
eligible
11
populations,
following
a
sixty-day
transition
period.
The
12
department
shall
transfer
the
long-term
services
and
supports
13
and
Medicare-Medicaid
dual
eligible
populations
to
the
Medicaid
14
fee-for-service
payment
and
delivery
system.
The
transition
15
shall
be
based
on
a
transition
plan
developed
by
the
department
16
and
submitted
to
the
council
on
human
services
and
the
medical
17
assistance
advisory
council
for
review.
The
department
of
18
human
services
shall
seek
any
Medicaid
state
plan
or
waiver
19
amendments
necessary
to
complete
the
transition.

Sec.
2.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
21
importance,
takes
effect
upon
enactment.

EXPLANATION
23
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
24
the
explanation’s
substance
by
the
members
of
the
general
assembly.
25
This
bill
requires
the
department
of
human
services
(DHS)
26
to
terminate
existing
contracts
with
Medicaid
managed
care
27
organizations
as
the
contracts
apply
to
the
Medicaid
long-term
28
services
and
supports
and
the
Medicare-Medicaid
dual
eligible
29
populations,
and
to
transfer
these
populations
from
the
30
Medicaid
managed
care
to
the
Medicaid
fee-for-service
payment
31
and
delivery
system.
The
transition
is
to
be
based
on
a
32
transition
plan
developed
by
DHS
and
submitted
to
the
council
33
on
human
services
and
the
medical
assistance
advisory
council
34
for
review.
DHS
is
required
to
seek
any
Medicaid
state
plan
or
