Section
1.
Section
321J.17,
subsection
1,
Code
2013,
is
1
amended
to
read
as
follows:
2
1.
If
the
department
revokes
a
person’s
driver’s
license
3
or
nonresident
operating
privilege
under
this
chapter
,
the
4
department
shall
assess
the
person
a
civil
penalty
of
two
5
hundred
dollars.
The
money
collected
by
the
department
under
6
this
section
shall
be
transmitted
to
the
treasurer
of
state
7
who
shall
deposit
one-half
of
the
money
in
the
separate
fund
8
established
in
section
915.94
and
one-half
of
the
money
in
the
9
general
fund
of
the
state.
A
temporary
restricted
license
10
shall
not
be
issued
unless
an
ignition
interlock
device
11
has
been
installed
pursuant
to
section
321J.4
.
A
Except
as
12
otherwise
provided
in
section
321J.20,
a
driver’s
license
13
or
nonresident
operating
privilege
shall
not
be
reinstated
14
unless
proof
of
deinstallation
of
an
ignition
interlock
device
15
installed
pursuant
to
section
321J.4
has
been
submitted
to
16
the
department.
Except
as
provided
in
section
321.210B
,
a
17
temporary
restricted
license
shall
not
be
issued
or
a
driver’s
18
license
or
nonresident
operating
privilege
reinstated
until
19
the
civil
penalty
has
been
paid.
A
person
assessed
a
penalty
20
under
this
section
may
remit
the
civil
penalty
along
with
a
21
processing
fee
of
five
dollars
to
a
county
treasurer
authorized
22
to
issue
driver’s
licenses
under
chapter
321M
,
or
the
civil
23
penalty
may
be
paid
directly
to
the
department.

Sec.
2.
Section
321J.20,
Code
2013,
is
amended
by
adding
the
25
following
new
subsection:

NEW
SUBSECTION
.
9.
A
person’s
election
to
keep
an
ignition
27
interlock
device
installed
in
the
person’s
vehicle
after
the
28
period
of
time
the
ignition
interlock
device
is
required
to
29
be
installed
shall
not
affect
reinstatement
of
the
person’s
30
driver’s
license
or
nonresident
operating
privilege
if
the
31
person
has
met
all
of
the
requirements
of
reinstatement
under
32
section
321J.17.

This
bill
provides
that
a
person’s
election
to

(conditions
for
reinstatement).

Current
law
provides
that
a
driver’s
license
or
nonresident

operating
privilege
shall
not
be
reinstated
unless
proof
of
8
deinstallation
has
been
submitted
to
the
department.
