  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 144.43, subsection 3, Code 2017, is
  1  2 amended to read as follows:
  1  3    3.  However, Notwithstanding any provision of law to the
  1  4 contrary, the following vital statistics records may be
  1  5 inspected and copied as of right under chapter 22 when they are
  1  6 in the custody of a county registrar or when they are in the
  1  7 custody of the state archivist and are at least seventy=five
  1  8  fifty years old:
  1  9    a.  A record of birth.
  1 10    b.  A record of marriage.
  1 11    c.  A record of divorce, dissolution of marriage, or
  1 12 annulment of marriage.
  1 13    d.  A record of death if that death was not a fetal death.
  1 14                           EXPLANATION
  1 15 The inclusion of this explanation does not constitute agreement with
  1 16 the explanation's substance by the members of the general assembly.
  1 17    This bill amends certain exceptions to the prohibition
  1 18 against the inspection and copying of vital statistics
  1 19 records in the custody of the county registrar or the state
  1 20 archivist for records of birth; marriage; divorce, dissolution
  1 21 of marriage, or annulment of marriage; and death. The bill
  1 22 reduces, from at least 75 years to at least 50 years, the age of
  1 23 the vital statistics record that may be inspected and copied.
  1 24 The bill also amends the reference to a record of death to
  1 25 eliminate the exclusion relating to records of death of a fetal
  1 26 death thereby allowing records of fetal death to be inspected
  1 27 and copied if the other requirements are met.
