144.29A,

as

Abortifacient
drugs

prohibited
in
the
state.

1.
Notwithstanding
any
other
provision
of
law
to
the
7
contrary,
it
is
unlawful
for
any
person
to
manufacture,
8
distribute,
prescribe,
dispense,
sell,
or
transfer
9
mifepristone,
mifegyne,
or
mifeprex,
or
any
substantially
10
similar
generic
or
non-generic
abortifacient
drug
in
the
state.

2.
A
person
who
violates
this
section
is
guilty
of
a
class
12
“C”
felony.
13
3.
This
section
shall
not
be
construed
to
impose
civil
14
or
criminal
liability
on
a
woman
upon
whom
an
abortion
is
15
performed
or
attempted
in
which
an
abortifacient
drug
otherwise
16
prohibited
under
this
section
is
used.
17
4.
This
section
shall
not
be
construed
to
prohibit
the
sale,
18
use,
prescription,
or
administration
of
any
contraceptive
agent
19
administered
prior
to
conception
or
before
a
pregnancy
can
be
20
confirmed
through
conventional
medical
testing.

EXPLANATION
22
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
23
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
notwithstanding
any
other
provision
25
of
law
to
the
contrary,
it
is
unlawful
for
any
person
to
26
manufacture,
distribute,
prescribe,
dispense,
sell,
or
transfer
27
generic
or
non-generic
abortifacient
drugs
in
the
state.
A
28
person
who
violates
the
bill
is
guilty
of
a
class
“C”
felony.
29
A
class
“C”
felony
is
punishable
by
confinement
for
no
more
30
than
10
years
and
a
fine
of
at
least
$1,370
but
not
more
than
31
$13,660.
32
The
bill
shall
not
be
construed
to
impose
civil
or
criminal

a
woman
upon
whom
an
abortion
is
performed
or

attempted
in
which
an
abortifacient
drug
otherwise
prohibited

bill
shall
not

bill
makes
a
conforming
change
in
the
Code
to
eliminate
a

reference
to
an
