Section
1.
Section
321J.4B,
subsection
11,
paragraph
a,
1
subparagraph
(2),
Code
2019,
is
amended
to
read
as
follows:

(2)
A
person
convicted
of
an
offense
under
subsection
2
3
shall
not
purchase
or
register
any
motor
vehicle
during
the
4
period
of
impoundment,
immobilization,
or
license
revocation
,
5
unless
the
person
holds
a
valid
temporary
restricted
license
6
issued
pursuant
to
section
321.215
or
321J.20
.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
if
a
person
operates
a
motor
vehicle
in
11
violation
of
Code
section
321J.2
(operating
while
intoxicated),
12
and
if
convicted,
the
conviction
would
be
a
second
or
13
subsequent
offense,
or
if
a
person
operates
a
motor
vehicle
14
while
that
person’s
driver’s
license
has
been
suspended,
15
denied,
revoked,
or
barred
due
to
a
violation
of
Code
section
16
321J.2,
the
motor
vehicle
operated
by
the
person
may
be
subject
17
to
impoundment
or
immobilization.
A
person
convicted
of
such
18
an
offense
is
prohibited
from
purchasing
or
registering
any
19
motor
vehicle
during
the
period
of
impoundment,
immobilization,
20
or
license
revocation.
This
bill
allows
a
person
convicted
21
of
such
an
offense
to
purchase
or
register
any
motor
vehicle
22
during
the
period
of
impoundment,
immobilization,
or
license
23
revocation,
if
the
person
holds
a
valid
temporary
restricted
24
license.
25
By
operation
of
law,
a
violation
of
this
provision
is
a
26
serious
misdemeanor
punishable
by
a
fine
of
at
least
$315
but
27
not
to
exceed
$1,875
and
imprisonment
not
to
exceed
one
year.
