  1  1    Section 1.  Section 321.215, Code 2015, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  5.  Notwithstanding any other provision
  1  4 of this chapter to the contrary, the department may issue a
  1  5 temporary restricted license to a person declared to be a
  1  6 habitual offender under section 321.555 who has also violated
  1  7 section 321.218 if the person meets the requirements for
  1  8 eligibility for a temporary restricted license under section
  1  9 321.560 and this section.
  1 10                           EXPLANATION
  1 11 The inclusion of this explanation does not constitute agreement with
  1 12 the explanation's substance by the members of the general assembly.
  1 13    This bill allows a person declared to be a habitual offender
  1 14 who has also been convicted of operating a vehicle with a
  1 15 suspended driver's license to be eligible for a temporary
  1 16 restricted license (TRL) if the person meets the requirements
  1 17 for eligibility for a TRL under Code section 321.560, which
  1 18 deals with TRLs for habitual offenders, and under Code section
  1 19 321.215, which deals with TRLs generally, including TRLs
  1 20 involving convictions for operating a vehicle with a suspended
  1 21 driver's license.
