  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 232.116, subsection 1, paragraph e,
  1  2 subparagraph (2), Code 2017, is amended to read as follows:
  1  3    (2)  The child has been removed from or was not placed in
  1  4  the physical custody of the child's parents for a period of at
  1  5 least six consecutive months.
  1  6    Sec. 2.  Section 232.116, subsection 1, paragraph f,
  1  7 subparagraph (3), Code 2017, is amended to read as follows:
  1  8    (3)  The child has been removed from or was not placed in the
  1  9 physical custody of the child's parents for at least twelve of
  1 10 the last eighteen months, or for the last twelve consecutive
  1 11 months and any trial period at home has been less than thirty
  1 12 days.
  1 13    Sec. 3.  Section 232.116, subsection 1, paragraph h,
  1 14 subparagraph (3), Code 2017, is amended to read as follows:
  1 15    (3)  The child has been removed from or was not placed in the
  1 16 physical custody of the child's parents for at least six months
  1 17 of the last twelve months, or for the last six consecutive
  1 18 months and any trial period at home has been less than thirty
  1 19 days.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    This bill relates to grounds for the termination of parental
  1 24 rights under Code chapter 232 when a child has been adjudicated
  1 25 a child in need of assistance.
  1 26    The bill amends existing grounds for termination of parental
  1 27 rights that each include as an element that the child has been
  1 28 removed from the physical custody of the child's parent for
  1 29 a specified period of time.  The bill amends this element to
  1 30 require that either the child has been removed from or was not
  1 31 placed in the physical custody of the child's parent for a
  1 32 specified period of time.
