Section 135.166, Code 2017, is amended to read 1 2 as follows: 1 3 135.166 Healthcaredata == collection and use == collection 1 4 from hospitals. 1 5 1. a. The department of public health shall enter into 1 6 a memorandum of understanding to utilize the Iowa hospital 1 7 association to act as the department's intermediary in 1 8 collecting, maintaining, and disseminating hospital inpatient, 1 9 outpatient, and ambulatoryinformationdata, as initially 1 10 authorized in 1996 Iowa Acts, ch. 1212, {5, subsection 1, 1 11 paragraph "a", subparagraph (4), and 641 IAC 177.3. 1 122.b. The memorandum of understanding shall include but 1 13 is not limited to provisions that address the duties of the 1 14 department and the Iowa hospital association regarding the 1 15 collection, reporting, disclosure, storage, and confidentiality 1 16 of the data. 1 17 2. Unless otherwise authorized or required by state 1 18 or federal law, data collected under this section shall 1 19 not include personally identifiable information about the 1 20 individual subject of the data, including but not limited to 1 21 the individual's name, date of birth, and social security 1 22 number. For the purposes of this subsection, "personally 1 23 identifiable information" means any item, collection, or 1 24 grouping of data which allows the individual subject of the 1 25 data to be identified. 1 26 EXPLANATION 1 27 The inclusion of this explanation does not constitute agreement with 1 28 the explanation's substance by the members of the general assembly. 1 29 This bill relates to health data collected and used by the 1 30 department of public health. 1 31 The bill amends Code section 135.166 to provide that unless 1 32 otherwise authorized by state or federal law, data collected 1 33 under Code section 135.166 shall not include personally 1 34 identifiable information about the individual subject of the 1 35 data, including but not limited to the individual's name, 2 1 date of birth, and social security number. The bill defines 2 2 "personally identifiable information" as any item, collection, 2 3 or grouping of data which allows the individual subject of the 2 4 data to be identified.
