  1  1    Section 1.  Section 730.5, subsection 9, paragraph e, Code
  1  2 2015, is amended to read as follows:
  1  3    e.  If the written policy provides for alcohol testing, the
  1  4 employer shall establish in the written policy a standard for
  1  5 alcohol concentration which shall be deemed to violate the
  1  6 policy. The standard for alcohol concentration shall not be
  1  7 less than .04 .02, expressed in terms of grams of alcohol per
  1  8 two hundred ten liters of breath, or its equivalent.
  1  9                           EXPLANATION
  1 10 The inclusion of this explanation does not constitute agreement with
  1 11 the explanation's substance by the members of the general assembly.
  1 12    Current law provides that a private employer may require
  1 13 alcohol testing of employees if the employer maintains a
  1 14 written policy for such testing that is provided to every
  1 15 employee subject to testing, and is available for review by
  1 16 employees and prospective employees. The policy must contain
  1 17 a standard for alcohol concentration which shall be deemed
  1 18 to violate the policy. The standard shall not be less than
  1 19 .04, expressed in terms of grams of alcohol per 210 liters of
  1 20 breath, or its equivalent.
  1 21    This bill lowers the minimum standard permitted to not less
  1 22 than .02, expressed in terms of grams of alcohol per 210 liters
  1 23 of breath, or its equivalent.
