Section 709.21, subsection 1, paragraph a, Code 1 2 2017, is amended to read as follows: 1 3 a. The other persondoes not have knowledge about and1 4 does not consent or is unable to consent to being viewed, 1 5 photographed, or filmed. 1 6 EXPLANATION 1 7 The inclusion of this explanation does not constitute agreement with 1 8 the explanation's substance by the members of the general assembly. 1 9 This bill relates to the criminal offense of invasion of 1 10 privacy. 1 11 The bill strikes, as an element of the offense, the 1 12 requirement that the victim of an invasion of privacy offense 1 13 does not have knowledge about being viewed, photographed, or 1 14 filmed, while in a state of full or partial nudity, and with a 1 15 reasonable expectation of privacy. 1 16 A person who commits invasion of privacy commits an 1 17 aggravated misdemeanor and is required to register as a sex 1 18 offender. A person who commits invasion of privacy is also 1 19 subject to a 10=year special sentence under Code section 1 20 903B.2. LSB 2304YH (2) 87 jm/rj
