Section 455C.2, Code 2017, is amended to read as 1 2 follows: 1 3 455C.2 Refund values. 1 4 1. A refund value of not less thanfiveten cents shall 1 5 be paid by the consumer on each beverage container sold in 1 6 this state by a dealer for consumption off the premises. 1 7 Upon return of the empty beverage container upon which a 1 8 refund value has been paid to the dealer or person operating 1 9 a redemption center and acceptance of the empty beverage 1 10 container by the dealer or person operating a redemption 1 11 center, the dealer or person operating a redemption center 1 12 shall return the amount of the refund value to the consumer. 1 13 2. In addition to the refund value provided in subsection 1 14 1of this section, a dealer, or person operating a redemption 1 15 center who redeems empty beverage containers or a dealer agent 1 16 shall be reimbursed by the distributor required to accept 1 17 the empty beverage containers an amount which isone cent 1 18three cents per container. A dealer, dealer agent, or person 1 19 operating a redemption center may compact empty metal beverage 1 20 containers with the approval of the distributor required to 1 21 accept the containers. 1 22 Sec. 2. Section 455C.5, subsection 3, Code 2017, is amended 1 23 to read as follows: 1 24 3. The provisions of subsections 1 and 2of this sectiondo 1 25 not apply to a refillable glass beverage container which has 1 26 a brand name permanently marked on it and which has a refund 1 27 value of not less thanfiveten cents, to any other refillable 1 28 beverage container which has a refund value of not less than 1 29fiveten cents and which is exempted by the director under 1 30 rules adopted by the commission, or to a beverage container 1 31 sold aboard a commercial airliner or passenger train for 1 32 consumption on the premises. 1 33 EXPLANATION 1 34 The inclusion of this explanation does not constitute agreement with 1 35 the explanation's substance by the members of the general assembly. 2 1 This bill increases the refund value paid by and returned 2 2 to consumers for beverage containers from 5 cents to 10 cents. 2 3 The bill modifies corresponding language regarding the refund 2 4 value printed on certain beverage containers. 2 5 The bill also increases the reimbursement amount received by 2 6 a dealer or person operating a redemption center who redeems 2 7 empty beverage containers from 1 cent per container to 3 cents 2 8 per container. The reimbursement amount, commonly referred 2 9 to as a handling fee, is paid by the distributor who collects 2 10 the beverage containers from the dealer or person operating a 2 11 redemption center.
