1.
Section
455E.11,
subsection
2,

management
account.
All

account

consist
of
moneys
appropriated
to,
transferred
to,
or

deposited
in
the
account,
including
fees
collected
pursuant
to

455B.473,
subsection

,
and
section
455B.479
,
shall

be
deposited
in
the
storage
tank
management
account
.
Moneys

deposited
in
the
account
shall
be
expended
for
all
of
the

following
purposes:

is
amended
by
adding
the
following
new
subparagraph:

SUBPARAGRAPH
.
(1A)
Moneys
transferred
under
this
Act
to

the
account
are
appropriated
for
the
following
purposes:

(a)
For
reimbursement
to
tank
owners
for
all
or
part
of
the
15
costs
of
a
corrective
action
for
a
petroleum
release.
16
(b)
For
the
appropriation
to
the
department
of
agriculture
17
and
land
stewardship
in
the
amount
of
two
hundred
fifty
18
thousand
dollars
for
the
purpose
of
inspecting
fuel
quality
at
19
pipeline
terminals
and
renewable
fuel
production
facilities,
20
including
associated
salaries,
support,
maintenance,
and
21
miscellaneous
purposes.

(c)
For
permanent
closure
of
an
underground
storage
tank
23
system
under
a
remedial
program
pursuant
to
section
455G.9,
24
for
additional
assessment
and
corrective
action
arising
out
of
25
releases
at
sites
for
which
a
certificate
of
no
further
action
26
has
been
issued,
and
for
tank
operator
training.
At
least
27
three
million
dollars
of
the
moneys
expended
pursuant
to
this
28
subparagraph
shall
be
expended
for
this
purpose.

3.
Section
455E.11,
subsection
2,
paragraph
d,

subparagraph
(2),
Code
2024,
is
amended
to
read
as
follows:

Sec.
4.
Section
455G.4,
Code
2024,
is
amended
by
adding
the
5
following
new
subsection:

NEW
SUBSECTION
.
7.
Repeal.
This
section
is
repealed
7
December
31,
2025.
On
or
before
November
29,
2024,
the
8
department
of
natural
resources,
in
consultation
with
the
9
board,
shall
propose
legislation
to
the
general
assembly
to
10
strike
or
repeal
provisions
referencing
the
board
and
the
Iowa
11
comprehensive
petroleum
underground
storage
tank
fund
created
12
in
section
455G.3
throughout
the
Code.

Sec.
5.
TRANSFER
OF
MONEYS.
On
the
effective
date
of
14
this
Act,
all
unencumbered
and
unobligated
moneys
in
the
15
Iowa
comprehensive
petroleum
underground
storage
tank
fund
16
created
in
section
455G.3
are
transferred
to
the
storage
tank
17
management
account
of
the
groundwater
protection
fund
created
18
in
section
455E.11.

EXPLANATION
20
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
use
of
moneys
in
the
storage
tank
23
management
account
of
the
groundwater
protection
fund
that
are
24
transferred
from
the
Iowa
comprehensive
petroleum
underground
25
storage
tank
fund.
26
The
groundwater
protection
fund
includes
four
accounts
27
related
to
groundwater:
the
solid
waste
account,
the
28
agriculture
management
account,
the
household
hazardous
waste
29
account,
and
the
storage
tank
management
account.
The
Iowa
30
comprehensive
petroleum
underground
storage
tank
fund
assists
31
owners
and
operators
of
petroleum
underground
storage
tanks
in
32
complying
with
federal
regulations.

The
bill
transfers
all
unencumbered
and
unobligated
moneys
34
in
the
Iowa
comprehensive
petroleum
underground
storage
tank

fund
on
the
effective
date
of
the
bill
to
the
storage
tank

management
account.
The
bill
provides
that
moneys
transferred
2
to
the
storage
tank
management
account
pursuant
to
the
bill
3
shall
be
used
to
reimburse
tank
owners
for
the
costs
associated
4
with
a
corrective
action
for
a
petroleum
release.
Of
the
5
moneys
transferred
from
the
Iowa
comprehensive
petroleum
6
underground
storage
tank
fund
to
the
storage
tank
management
7
account,
at
least
$3
million
shall
be
used
for
the
permanent
8
closure
of
underground
storage
tank
systems,
actions
arising
9
from
sites
where
certificates
of
no
further
action
have
10
been
issued,
and
tank
operator
training,
and
$250,000
shall
11
be
appropriated
to
the
department
of
agriculture
and
land
12
stewardship
for
inspecting
fuel
quality
at
pipeline
terminals
13
and
renewable
fuel
production
facilities.

The
bill
repeals
the
Iowa
comprehensive
petroleum
15
underground
storage
tank
fund
board
(board)
on
December
31,
16
2025.
The
department
of
natural
resources
and
the
board
shall
17
propose
legislation
to
eliminate
references
to
the
board
and
18
the
Iowa
comprehensive
petroleum
underground
storage
tank
fund
19
on
or
before
November
29,
2024.
