REBUILD IOWA INFRASTRUCTURE FUND ==== 1 4 APPROPRIATIONS. There is appropriated from the rebuild Iowa 1 5 infrastructure fund to the following departments and agencies 1 6 for the following fiscal years, the following amounts, or so 1 7 much thereof as is necessary, to be used for the purposes 1 8 designated: 1 9 1. DEPARTMENT OF ADMINISTRATIVE SERVICES 1 10 For major maintenance projects: 1 11 FY 2018=2019: 1 12 .................................................. $ 25,000,000 1 13 Of the moneys appropriated in this subsection for the fiscal 1 14 year beginning July 1, 2018, the department shall give priority 1 15 to projects for repair of the roof of the state historical 1 16 building. 1 17 FY 2019=2020: 1 18 .................................................. $ 20,000,000 1 19 FY 2020=2021: 1 20 .................................................. $ 20,000,000 1 21 FY 2021=2022: 1 22 .................................................. $ 20,000,000 1 23 FY 2022=2023: 1 24 .................................................. $ 20,000,000 1 25 2. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 1 26 a. (1) For deposit in the water quality initiative fund 1 27 created in section 466B.45 for purposes of supporting the 1 28 water quality initiative administered by the division of soil 1 29 conservation and water quality as provided in section 466B.42, 1 30 including salaries, support, maintenance, and miscellaneous 1 31 purposes, notwithstanding section 8.57, subsection 5, paragraph 1 32 "c": 1 33 FY 2018=2019: 1 34 .................................................. $ 5,200,000 1 35 (2) (a) The moneys appropriated in this lettered 2 1 paragraph shall be used to support demonstration projects in 2 2 subwatersheds as designated by the department that are part 2 3 of high=priority watersheds identified by the water resources 2 4 coordinating council. 2 5 (b) The moneys appropriated in this lettered paragraph 2 6 shall be used to support demonstration projects in watersheds 2 7 generally, including regional watersheds, as designated by the 2 8 division and high=priority watersheds identified by the water 2 9 resources coordinating council. 2 10 (3) In supporting projects in watersheds and subwatersheds 2 11 as provided in subparagraph (2), subparagraph divisions (a) and 2 12 (b), all of the following shall apply: 2 13 (a) The demonstration projects shall utilize water quality 2 14 practices as described in the latest revision of the document 2 15 entitled "Iowa Nutrient Reduction Strategy" initially presented 2 16 in November 2012 by the department of agriculture and land 2 17 stewardship, the department of natural resources, and Iowa 2 18 state university of science and technology. 2 19 (b) The division shall implement demonstration projects 2 20 as provided in subparagraph division (a) by providing 2 21 for participation by persons who hold a legal interest in 2 22 agricultural land used in farming. To every extent practical, 2 23 the division shall provide for collaborative participation by 2 24 such persons who hold a legal interest in agricultural land 2 25 located within the same subwatershed. 2 26 (c) The division shall implement demonstration projects on 2 27 a cost=share basis as determined by the division. Except for 2 28 edge=of=field practices, the state's share of the amount shall 2 29 not exceed 50 percent of the estimated cost of establishing the 2 30 practice as determined by the division or 50 percent of the 2 31 actual cost of establishing the practice, whichever is less. 2 32 (d) The demonstration projects shall be used to educate 2 33 other persons about the feasibility and value of establishing 2 34 similar water quality practices. The division shall promote 2 35 field day events for purposes of allowing interested persons to 3 1 establish water quality practices on their agricultural land. 3 2 (e) The division shall conduct water quality evaluations 3 3 within supported subwatersheds. Within a reasonable period 3 4 after accumulating information from such evaluations, the 3 5 division shall create an aggregated database of water quality 3 6 practices. Any information identifying a person holding a 3 7 legal interest in agricultural land or specific agricultural 3 8 land shall be a confidential record. 3 9 (4) The moneys appropriated in this lettered paragraph 3 10 shall be used to support education and outreach in a manner 3 11 that encourages persons who hold a legal interest in 3 12 agricultural land used for farming to implement water quality 3 13 practices, including the establishment of such practices in 3 14 watersheds generally, and not limited to subwatersheds or 3 15 high=priority watersheds. 3 16 (5) The moneys appropriated in this lettered paragraph 3 17 may be used to contract with persons to coordinate the 3 18 implementation of efforts provided in this paragraph. 3 19 (6) The moneys appropriated in this lettered paragraph 3 20 may be used by the department to support urban soil and water 3 21 conservation efforts, which may include but are not limited 3 22 to management practices related to bioretention, landscaping, 3 23 the use of permeable or pervious pavement, and soil quality 3 24 restoration. The moneys shall be allocated on a cost=share 3 25 basis as provided in chapter 161A. 3 26 (7) Notwithstanding any other provision of law to the 3 27 contrary, the department may use moneys appropriated in 3 28 this lettered paragraph to carry out the provisions of this 3 29 paragraph on a cost=share basis in combination with other 3 30 moneys available to the department from a state or federal 3 31 source. 3 32 (8) Not more than 10 percent of the moneys appropriated in 3 33 this lettered paragraph may be used for costs of administration 3 34 and implementation of the water quality initiative administered 3 35 by the soil conservation division. 4 1 b. For deposit in the agricultural drainage well water 4 2 quality assistance fund created in section 460.303 for 4 3 purposes of supporting the agricultural drainage well water 4 4 quality assistance program as provided in section 460.304, 4 5 notwithstanding section 8.57, subsection 5, paragraph "c": 4 6 FY 2018=2019: 4 7 .................................................. $ 1,875,000 4 8 Not more than 10 percent of the moneys appropriated in this 4 9 lettered paragraph may be used for costs of administration and 4 10 implementation of soil conservation practices. 4 11 c. However, if the project or projects for 13 8 which such appropriation was made are completed in an earlier 13 9 fiscal year, unencumbered or unobligated moneys shall revert at 13 10 the close of that same fiscal year. 13 11 DIVISION III 13 12 CHANGES TO PRIOR APPROPRIATIONS 13 13 Sec. 5. 2012 Iowa Acts, chapter 1140, section 4, as amended 13 14 by 2016 Iowa Acts, chapter 1133, section 9, is amended to read 13 15 as follows: 13 16 SEC. 4. REVERSION. 13 17 1. Except as provided in subsection 2, for purposes 13 18 of section 8.33, unless specifically provided otherwise, 13 19 unencumbered or unobligated moneys made from an appropriation 13 20 in this division of this Act shall not revert but shall remain 13 21 available for expenditure for the purposes designated until the 13 22 close of the fiscal year that ends three years after the end of 13 23 the fiscal year for which the appropriation was made. However, 13 24 if the project or projects for which such appropriation was 13 25 made are completed in an earlier fiscal year, unencumbered 13 26 or unobligated moneys shall revert at the close of that same 13 27 fiscal year. 13 28 2. For purposes of section 8.33, unless specifically 13 29 provided otherwise, unencumbered or unobligated moneys 13 30 appropriated in section 3, subsection 3, paragraph "b", of 13 31 this division of this Act, shall not revert but shall remain 13 32 available for the purpose designated until the close of the 13 33 fiscal year that begins July 1,20172019, or until the project 13 34 for which the appropriation was made is completed, whichever 13 35 is earlier. 14 1 Sec. 6. 2014 Iowa Acts, chapter 1136, section 1, subsection 14 2 7, paragraph b, as amended by 2016 Iowa Acts, chapter 1133, 14 3 section 10, and 2017 Iowa Acts, chapter 173, section 9, is 14 4 amended to read as follows: 14 5 b. However, if the project or projects for 15 12 which such appropriation was made are completed in an earlier 15 13 fiscal year, unencumbered or unobligated moneys shall revert at 15 14 the close of that same fiscal year. 15 15 2. For purposes of section 8.33, unencumbered or 15 16 unobligated moneys from an appropriation in section 1, 15 17 subsection 5, paragraph "c", in this division of this Act 15 18 shall not revert but shall remain available for the purposes 15 19 designated until the close of the fiscal year that begins July 15 20 1, 2018, or until the project for which the appropriation was 15 21 made is completed, whichever is earlier. 15 22 Sec. 9. 2015 Iowa Acts, chapter 139, section 1, subsection 15 23 10, paragraph b, as amended by 2017 Iowa Acts, chapter 173, 15 24 section 11, is amended to read as follows: 15 25 b. DEPARTMENT OF ADMINISTRATIVE SERVICES 16 30 For costs associated with the repair and renovation of the 16 31 dome of the Iowa state capitol: 16 32 .................................................. $ 9,990,900 16 33 As a condition of receiving the appropriation provided in 16 34 this subsection, the department shall not expend any moneys to 16 35 pay an owners' representative fee related to the repair and 17 1 renovation of the dome of the Iowa state capitol. 17 2 Of the moneys appropriated in this subsection, the 17 3 department shall be authorized to expend such amount as is 17 4 necessary for the costs of installing outdoor lighting at the 17 5 Iowa state capitol. 17 6 From any moneys appropriated in this subsection and 17 7 remaining upon completion of the repair and renovation of the 17 8 dome of the Iowa state capitol, the department shall expend 17 9 such amount as is necessary for maintenance projects for 17 10 the Iowa state capitol and the Ola Babcock Miller building. 17 11 However, any unencumbered or unobligated moneys made from an 17 12 appropriation in this subsection and remaining at the close of 17 13 the fiscal year beginning July 1, 2017, shall be deposited in 17 14 the state capitol maintenance fund created in section 2.12B. 17 15 Sec. 12. 2017 Iowa Acts, chapter 173, is amended by adding 17 16 the following new section: 17 17 NEW SECTION. 4A. REVERSION. For purposes of section 17 18 8.33, unless specifically provided otherwise, unencumbered or 17 19 unobligated moneys made from an appropriation in section 4 17 20 shall not revert but shall remain available for expenditure for 17 21 the purposes designated until the close of the fiscal year that 17 22 ends three years after the end of the fiscal year for which the 17 23 appropriation is made. However, if the project or projects for 17 24 which such appropriation was made are completed in an earlier 17 25 fiscal year, unencumbered or unobligated moneys shall revert at 17 26 the close of that same fiscal year. 17 27 Sec. 13. EFFECTIVE DATE. This division of this Act, being 17 28 deemed of immediate importance, takes effect upon enactment. 17 29 DIVISION IV 17 30 MISCELLANEOUS PROVISIONS 17 31 Sec. 14. Section 8.57C, subsection 3, paragraph a, 17 32 subparagraph (2), Code 2018, is amended to read as follows: 17 33 (2) The fiscal year beginning July 1,20182019, and for 17 34 each subsequent fiscal year thereafter. 17 35 Sec. 15. Section 8.57C, subsection 3, Code 2018, is amended 18 1 by adding the following new paragraph: 18 2 NEW PARAGRAPH. g. There is appropriated from the rebuild 18 3 Iowa infrastructure fund for the fiscal year beginning July 1, 18 4 2018, and ending June 30, 2019, the sum of fourteen million 18 5 four hundred thousand dollars to the technology reinvestment 18 6 fund, notwithstanding section 8.57, subsection 5, paragraph 18 7 "c". 18 8 DIVISION V 18 9 MAINTENANCE FUNDS 18 10 Sec. 16. NEW SECTION. 2.12B State capitol maintenance fund 18 11 ==== appropriation. 18 12 1. A state capitol maintenance fund is created in the state 18 13 treasury under the control of the legislative council. The 18 14 fund shall consist of all moneys appropriated to the fund. 18 15 2. There is appropriated from the rebuild Iowa 18 16 infrastructure fund for deposit in the state capitol 18 17 maintenance fund, for the fiscal year beginning July 1, 2018, 18 18 and for each fiscal year thereafter, the sum of five hundred 18 19 thousand dollars. 18 20 3. Moneys in the state capitol maintenance fund shall be 18 21 expended upon approval of the legislative council and used for 18 22 maintenance projects for the Iowa state capitol and the Ola 18 23 Babcock Miller building. 18 24 4. Notwithstanding section 12C.7, subsection 2, interest or 18 25 earnings on moneys deposited in the state capitol maintenance 18 26 fund shall be credited to the state capitol maintenance fund. 18 27 Notwithstanding section 8.33, moneys credited to the state 18 28 capitol maintenance fund shall not revert at the close of a 18 29 fiscal year. 18 30 Sec. 17. NEW SECTION. 8A.331 Routine maintenance fund ==== 18 31 appropriation. 18 32 1. A routine maintenance fund is created in the state 18 33 treasury under the control of the department. The fund shall 18 34 consist of all moneys appropriated to the fund. 18 35 2. There is appropriated from the rebuild Iowa 19 1 infrastructure fund to the department for deposit in the 19 2 routine maintenance fund, for the fiscal year beginning July 19 3 1, 2018, and for each fiscal year thereafter, the sum of two 19 4 million dollars. 19 5 3. Moneys in the routine maintenance fund are appropriated 19 6 to the department for purposes of routine maintenance 19 7 projects for physical properties under the control of the 19 8 department. For purposes of this section, routine maintenance 19 9 includes regular upkeep of physical properties and recurring, 19 10 preventive, and ongoing maintenance necessary to delay or 19 11 prevent the failure of physical properties. 19 12 4. Notwithstanding section 12C.7, subsection 2, interest 19 13 or earnings on moneys deposited in the routine maintenance 19 14 fund shall be credited to the routine maintenance fund. 19 15 Notwithstanding section 8.33, moneys credited to the routine 19 16 maintenance fund shall not revert at the close of a fiscal 19 17 year. 19 18 EXPLANATION 19 19 The inclusion of this explanation does not constitute agreement with 19 20 the explanation's substance by the members of the general assembly. 19 21 This bill relates to and makes appropriations to state 19 22 departments and agencies from the rebuild Iowa infrastructure 19 23 fund and the technology reinvestment fund, and provides for 19 24 related matters. The bill is organized by divisions. 19 25 DIVISION I ==== REBUILD IOWA INFRASTRUCTURE FUND. This 19 26 division appropriates project funding for FY 2018=2019 from 19 27 the rebuild Iowa infrastructure fund for projects for the 19 28 departments of agriculture and land stewardship, cultural 19 29 affairs, human services, natural resources, public defense, 19 30 public safety, and transportation, and for the office of the 19 31 chief information officer, economic development authority, 19 32 law enforcement academy, treasurer of state, and the judicial 19 33 branch. The division also appropriates project funding from 19 34 the rebuild Iowa infrastructure fund for multiple fiscal years 19 35 to the department of administrative services and the board of 20 1 regents. 20 2 DIVISION II ==== TECHNOLOGY REINVESTMENT FUND. This division 20 3 appropriates project funding for FY 2018=2019 from the 20 4 technology reinvestment fund for the departments of education, 20 5 human rights, management, public health, homeland security and 20 6 emergency management, public safety, and natural resources, 20 7 and for the office of the chief information officer, the 20 8 state public defender, judicial branch, and board of parole. 20 9 This division also appropriates project funding for multiple 20 10 fiscal years beginning in FY 2018=2019 from the technology 20 11 reinvestment fund to the department of human services and the 20 12 secretary of state. 20 13 DIVISION III ==== CHANGES TO PRIOR APPROPRIATIONS. This 20 14 division makes a change to the reversion provision for 20 15 moneys appropriated to the department of education from the 20 16 technology reinvestment fund in FY 2012=2013. The division 20 17 makes a change to moneys appropriated from the rebuild Iowa 20 18 infrastructure fund to the board of regents for a project at 20 19 the state university of Iowa and for projects at the Iowa 20 20 state university of science and technology, and the state 20 21 fair authority to authorize reimbursement of infrastructure 20 22 costs incurred in the prior fiscal year. The division also 20 23 changes project funding for a project at the Iowa state 20 24 university of science and technology. The division also makes 20 25 a change to the reversion provision applicable to moneys 20 26 appropriated from the rebuild Iowa infrastructure fund to the 20 27 department of natural resources for FY 2014=2015, and adds a 20 28 reversion provision to moneys appropriated from the technology 20 29 reinvestment fund in the 2017 Iowa Acts. The division also 20 30 provides that any moneys remaining from an appropriation for 20 31 the repair of the dome of the Iowa state capitol at the close of 20 32 the fiscal year beginning July 1, 2017, shall be deposited in 20 33 the state capitol maintenance fund created in the bill. 20 34 This division takes effect upon enactment. 20 35 DIVISION IV ==== MISCELLANEOUS PROVISIONS. Code section 21 1 8.57C, concerning the technology reinvestment fund, is amended 21 2 to provide that the appropriation to the fund from the general 21 3 fund for fiscal years beginning on or after July 1, 2018, is 21 4 changed to fiscal years beginning on or after July 1, 2019, and 21 5 to provide for an appropriation to the fund from the rebuild 21 6 Iowa infrastructure fund for the fiscal year beginning July 1, 21 7 2018, of $14.4 million. 21 8 DIVISION V ==== MAINTENANCE FUNDS. This division creates two 21 9 new maintenance funds. 21 10 New Code section 2.12B creates a state capitol maintenance 21 11 fund in the state treasury under the control of the legislative 21 12 council. The new Code section provides an annual standing 21 13 appropriation of $500,000 from the rebuild Iowa infrastructure 21 14 fund for deposit in the new fund beginning in FY 2018=2019. 21 15 Moneys in the state capitol maintenance fund shall be 21 16 expended upon approval of the legislative council and used for 21 17 maintenance projects at the Iowa state capitol and the Ola 21 18 Babcock Miller building. The bill provides that interest or 21 19 earnings on moneys deposited in the fund shall be credited to 21 20 the fund and moneys credited to the fund shall not revert at 21 21 the close of a fiscal year. 21 22 New Code section 8A.331 creates a routine maintenance fund 21 23 in the state treasury under the control of the department of 21 24 administrative services. The new Code section provides an 21 25 annual standing appropriation of $2 million from the rebuild 21 26 Iowa infrastructure fund for deposit in the new fund beginning 21 27 in FY 2018=2019. Moneys in the routine maintenance fund are 21 28 appropriated to the department of administrative services 21 29 for purposes of routine maintenance projects for physical 21 30 properties under the control of the department. The bill 21 31 provides that routine maintenance includes regular upkeep of 21 32 physical properties and recurring, preventive, and ongoing 21 33 maintenance necessary to delay or prevent the failure of 21 34 physical properties.
