H.F. 2491 Section 1. Section 805.8A, subsection 14, paragraph l, Code 1 2020, is amended to read as follows: 2 l. Writing, sending, or viewing an electronic message while 3 driving violations. 4 (1) For violations under section 321.276 that occur within a 5 school district as defined in section 321.1, subsection 70, the 6 scheduled fine is sixty dollars. 7 (2) For all other violations under section 321.276 , the 8 scheduled fine is thirty dollars. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 Under current law, a person who writes, sends, or views 13 an electronic message while driving in violation of Code 14 section 321.276 is subject to a scheduled fine of $30. This 15 bill provides that a person who writes, sends, or views an 16 electronic message while driving in violation of Code section 17 321.276 within a school district is subject to a scheduled fine 18 of $60. “School district” is defined in Code section 321.1(70) 19 as the territory contiguous to and including a highway for a 20 distance of 200 feet in either direction from a schoolhouse 21 in a city. Under Code section 321.285, the speed limit in a 22 school district is 25 miles per hour, and a school district 23 must be marked by distinctive signs. 24 -1- LSB 5972HV (1) 88 mo/ns 1/ 1
