Section
1.
Section
29C.9,
subsection
6,
Code
Supplement
1
2011,
is
amended
to
read
as
follows:

6.
a.
The
commission
shall
determine
the
mission
of
its
3
agency
and
program
and
provide
direction
for
the
delivery
of
4
the
emergency
management
services
of
planning,
administration,
5
coordination,
training,
and
support
for
local
governments
6
and
their
departments.
The
commission
shall
coordinate
its
7
services
in
the
event
of
a
disaster.
8
b.
The
commission
may
also
provide
joint
emergency
response
9
communications
services
through
an
agreement
entered
into
10
under
chapter
28E
.
The
board
or
governing
body
of
an
entity
11
created
under
chapter
28E
to
provide
joint
emergency
response
12
communications
services
shall
only
include
individuals
who
13
are
elected
public
officials
currently
holding
office
within
14
the
area
being
provided
such
communications
services.
The
15
membership
of
the
board
or
governing
body
of
such
an
entity
16
shall
not
be
the
same
membership
as
the
certifying
board
for
17
all
or
any
portion
of
the
entity’s
budget
or
for
any
property
18
tax
levy
from
which
the
entity
receives
funding.
All
tax
19
levies
and
expenditures
of
such
an
entity
shall
be
subject
to
20
the
provisions
of
chapter
24,
and,
prior
to
approval
of
the
21
budget
by
the
certifying
board,
each
public
agency
that
is
22
a
party
to
the
agreement
under
chapter
28E
that
is
not
the
23
certifying
board
for
the
budget
or
levy
shall
approve
the
24
proposed
budget
by
resolution.
The
proposed
budget
of
such
an
25
entity
is,
however,
subject
to
modification
by
the
political
26
subdivision
that
is
the
certifying
board
for
the
entity’s
27
budget
and
property
tax
levy.

Sec.
2.
IMPLEMENTATION.
This
Act
shall
not
be
construed
to
29
invalidate
the
creation
of
or
the
actions
taken
by
an
entity
30
created
under
chapter
28E
to
provide
joint
emergency
response
31
communications
services
prior
to
the
effective
date
of
this
32
Act.
33
Sec.
3.
EFFECTIVE
UPON
ENACTMENT.
This
Act,
being
deemed
of
34
immediate
importance,
takes
effect
upon
enactment.

This
Act
applies
to
entities

created
under
chapter
28E
to
provide
joint
emergency
response

communications
services
before,
on,
and
after
the
effective

date
of
this
Act.

EXPLANATION
5
Current
Code
section
29C.9(6)
allows
a
county
emergency
6
management
commission
to
provide
joint
emergency
response
7
communications
services
through
an
agreement
entered
into
8
under
Code
chapter
28E.
This
bill
provides
that
the
board
or
9
governing
body
of
an
entity
created
under
Code
chapter
28E
10
to
provide
joint
emergency
response
communications
services
11
shall
only
include
individuals
who
are
elected
public
officials
12
currently
holding
office
within
the
area
being
provided
such
13
communications
services.
The
bill
provides
that
the
board
or
14
governing
body
of
such
an
entity
shall
not
be
the
certifying

board
for
all
