  1 An Act relating to salaries and apportionment of judicial
  2    officers and including effective date provisions.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 602.1501, Code 2016, is amended by
  1  2 striking the section and inserting in lieu thereof the
  1  3 following:
  1  4    602.1501  Judicial salaries.
  1  5    The salaries of all judicial officers as defined in section
  1  6 602.1101 shall be set by the supreme court and paid from the
  1  7 general operating moneys appropriated to the judicial branch.
  1  8 A salary increase approved by the supreme court shall be made a
  1  9 public record through a court order no less than thirty days
  1 10 prior to the effective date of the increase.  A salary increase
  1 11 shall not take effect in a fiscal year until the general
  1 12 operating moneys for the judicial branch have been appropriated
  1 13 for that fiscal year.
  1 14    Sec. 2.  Section 602.6201, subsections 5, 6, 7, and 10, Code
  1 15 2016, are amended by striking the subsections.
  1 16    Sec. 3.  Section 602.6301, Code 2016, is amended by striking
  1 17 the section and inserting in lieu thereof the following:
  1 18    602.6301  Number and apportionment of district associate
  1 19 judges.
  1 20    The supreme court shall prescribe, subject to the
  1 21 restrictions of this section, a formula to determine the
  1 22 number of district associate judges serving in each judicial
  1 23 election district.  The formula shall be based on a model that
  1 24 measures and applies an estimated case=related workload formula
  1 25 of judicial officers, and shall account for administrative
  1 26 duties, travel time, and other judicial duties not related to a
  1 27 specific case.
  1 28    Sec. 4.  Section 602.6401, subsection 1, Code 2016, is
  1 29 amended to read as follows:
  1 30    1.  Two hundred six magistrates Magistrates shall be
  1 31 apportioned among the counties as provided in this section.
  1 32 Magistrates appointed pursuant to section 602.6303 or 602.6402
  1 33 shall not be counted for purposes of this section.
  1 34    Sec. 5.  Section 602.9104, subsection 1, paragraph a, Code
  1 35 2016, is amended to read as follows:
  2  1    a.  A judge to whom this article applies shall be paid an
  2  2 amount equal to the basic salary of the judge as set by the
  2  3 general assembly reduced by an amount designated as the judge's
  2  4 required contribution to the judicial retirement fund. The
  2  5 amount designated as the judge's required contribution shall be
  2  6 paid by the state in the manner provided in subsection 2.
  2  7    Sec. 6.  Section 602.9204, subsection 1, paragraph a, Code
  2  8 2016, is amended to read as follows:
  2  9    a.  A judge who retires on or after July 1, 1994, and who is
  2 10 appointed a senior judge under section 602.9203 shall be paid a
  2 11 salary as determined by the general assembly supreme court.
  2 12    Sec. 7.  2008 Iowa Acts, chapter 1191, section 14, subsection
  2 13 7, as amended by 2010 Iowa Acts, chapter 1193, section 26, is
  2 14 amended to read as follows:
  2 15    7.  The following are range 7 positions: administrator
  2 16 of the public broadcasting division of the department of
  2 17 education, director of the department of corrections, director
  2 18 of the department of education, director of human services,
  2 19 director of the department of economic development, executive
  2 20 director of the Iowa telecommunications and technology
  2 21 commission, executive director of the state board of regents,
  2 22 director of transportation, director of the department of
  2 23 workforce development, director of revenue, director of
  2 24 public health, state court administrator, director of the
  2 25 department of management, chief information officer, state debt
  2 26 coordinator, and director of the department of administrative
  2 27 services.
  2 28    Sec. 8.  REPEAL.  2013 Iowa Acts, chapter 140, section 40,
  2 29 is repealed.
  2 30    Sec. 9.  EFFECTIVE DATE.  The following provision or
  2 31 provisions of this Act take effect July 1, 2017:
  2 32    1.  The section of this Act amending section 602.1501.
  2 33    2.  The section of this Act amending section 602.9204.
  2 34    3.  The section of this Act repealing 2013 Iowa Acts, chapter
  2 35 140, section 40.
