Section
1.
Section
8A.321,
subsection
6,
paragraph
c,
1
subparagraph
(1),
Code
2024,
is
amended
to
read
as
follows:

(1)
Prior
to
replacing
or
renovating
publicly
owned
3
buildings
or
relocating
any
state
agencies
at
the
seat
of
4
government
to
any
space
in
publicly
owned
buildings,
the
5
department
shall
may
issue
a
request
for
proposals
for
leasing
6
privately
owned
office
space
for
state
employees
in
the
7
downtown
area
of
the
city
of
Des
Moines
and
shall
may
use
8
such
proposals
to
compare
the
costs
of
privately
owned
space
9
to
publicly
owned
space.
The
department
shall
locate
state
10
employees
in
office
space
in
the
most
cost-efficient
manner
11
possible.
In
determining
cost
efficiency,
the
department
shall
12
consider
all
costs
of
the
publicly
owned
space,
the
costs
of
13
the
original
acquisition
of
the
publicly
owned
space,
the
costs
14
of
tenant
improvements
to
the
publicly
owned
space,
and
the
15
anticipated
economic
and
useful
life
of
the
publicly
owned
16
building
space.
For
purposes
of
this
subparagraph,
“publicly
17
owned
building”
does
not
include
existing
space
within
buildings
18
located
at
the
capitol
complex
or
otherwise
owned
by
the
state.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
requires
that,
prior
to
replacing
or
renovating
23
publicly
owned
buildings
or
relocating
any
state
agencies
in
24
Des
Moines
within
publicly
owned
buildings,
the
director
of
25
the
department
of
administrative
services
issue
a
request
for
26
proposals
for
leasing
privately
owned
office
space
and
use
27
such
proposals
to
compare
costs
of
the
public
and
private
28
spaces.
This
bill
excludes
existing
space
within
capitol
29
complex
buildings
and
buildings
owned
by
the
state
from
the
30
term
“publicly
owned
building”
for
purposes
of
this
process.
31
The
bill
also
makes
the
decision
to
issue
or
use
a
request
for
32
proposals
discretionary.

The
bill
does
not
amend
the
provisions
under
current
law
34
providing
for
an
exemption
to
this
process
in
emergency
