  1 An Act prohibiting the purchase of weapons seized as a public

  1  1    Section 1.  Section 483A.33, Code 2016, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  6.  The director, any peace officer,  an
  1  4 employee of the department, or a member of their immediate
  1  5 family shall not purchase a weapon seized pursuant to section
  1  6 483A.32 and disposed of pursuant to this section or section
  1  7 809.21.  For purposes of this subsection, "member of their
  1  8 immediate family" means a spouse, child, stepchild, brother,
  1  9 brother=in=law, stepbrother, sister, sister=in=law, stepsister,
  1 10 parent, parent=in=law, or stepparent of the director, a peace
  1 11 officer, or an employee of the department who resides in the
  1 12 same household in the same principal residence of the director,
  1 13 a peace officer, or an employee of the department.
  1 14                           EXPLANATION
  1 15 The inclusion of this explanation does not constitute agreement with
  1 16 the explanation's substance by the members of the general assembly.
  1 17    This bill prohibits the director, any peace officer, and
  1 18 employees of the department of natural resources and members
  1 19 of their immediate families from purchasing a weapon seized
  1 20 as a public nuisance incident to a violation of specified
  1 21 statutes pertaining to wildlife laws and sold at a public
  1 22 sale or auction by the department of natural resources or
  1 23 the department of public safety. Legal weapons, including
  1 24 rifles and shotguns, seized in this manner are disposed of,
  1 25 as provided by rule, by the department at its annual public
  1 26 sale. Other legal weapons seized may be sold by the department
  1 27 of public safety at public auction pursuant to Code section
  1 28 809.21.
