H.F. 2380 Section 1. Section 299A.8, subsection 1, Code 2024, is 1 amended to read as follows: 2 1. If a parent, guardian, or legal custodian of a school-age 3 child who is receiving competent private instruction under this 4 chapter submits a request, the child shall also be registered 5 in a public school for dual enrollment purposes. If the child 6 is enrolled in a public school district for dual enrollment 7 purposes, the child shall be permitted to participate in any 8 academic activities in the district and shall also be permitted 9 to participate on the same basis as public school children in 10 any extracurricular activities available to children in the 11 child’s grade or group. Dual enrollment of a child solely 12 for purposes of accessing the annual achievement evaluation 13 shall not constitute a dual enrollment purpose. A child who is 14 enrolled in a public school for dual enrollment purposes may 15 receive any amount of instruction by way of the public school’s 16 academic programs, including offerings pursuant to chapter 17 261E. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill relates to the amount of instruction a student who 22 is enrolled in a school district for dual enrollment purposes 23 may receive under the school district’s academic programs. 24 Pursuant to administrative rule adopted by the department of 25 education, a child under dual enrollment must receive at least 26 one-quarter of the child’s instruction by way of competent 27 private instruction and no more than three-quarters by way 28 of a school district’s academic programs. The bill renders 29 the department’s administrative rule void by providing that a 30 child who is enrolled in a school district for dual enrollment 31 purposes may receive any amount of instruction by way of the 32 school district’s academic programs, including offerings 33 pursuant to Code chapter 261E (senior year plus program). 34 -1- LSB 6220YH (2) 90 jda/jh 1/ 1
