  1  1    Section 1.  Section 256.7, Code 2018, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  33.  a.  For purposes of this subsection:
  1  4    (1)  "Postvention" means the same as defined in section
  1  5 279.70.
  1  6    (2)  "Trauma=informed care" means the same as defined in
  1  7 section 279.70.
  1  8    b.  Adopt rules to require school districts to adopt
  1  9 protocols for suicide prevention and postvention and
  1 10 trauma=informed care. The protocols shall be based on
  1 11 nationally recognized best practices.
  1 12    Sec. 2.  NEW SECTION.  279.70  Suicide prevention and
  1 13 trauma=informed care training.
  1 14    1.  For purposes of this section, unless the context
  1 15 otherwise requires:
  1 16    a.  "Postvention" means the provision of crisis intervention,
  1 17 support, and assistance for those affected by a suicide or
  1 18 suicide attempt to prevent further risk of suicide.
  1 19    b.  "Trauma=informed care" means services that are based
  1 20 on an understanding of the vulnerabilities and triggers of
  1 21 individuals who have experienced trauma, recognize the role
  1 22 trauma has played in the lives of those individuals, recognize
  1 23 the presence and onset of trauma symptoms, are supportive of
  1 24 trauma recovery, and avoid further traumatization.
  1 25    2.  By July 1, 2019, the board of directors of a school
  1 26 district shall integrate annual, evidence=based training at
  1 27 least one hour in length on suicide prevention and postvention
  1 28 for all school personnel who hold a license, certificate,
  1 29 authorization, or statement of recognition issued by the
  1 30 board of educational examiners and who have regular contact
  1 31 with students in grades six through twelve into the school
  1 32 district's comprehensive school improvement plan submitted
  1 33 pursuant to section 256.7, subsection 21. The content of
  1 34 the training shall be based on nationally recognized best
  1 35 practices.
  2  1    3.  By July 1, 2019, the board of directors of a
  2  2 school district shall integrate annual, evidence=based,
  2  3 evidence=supported training on trauma=informed care for
  2  4 all school personnel who hold a license, certificate,
  2  5 authorization, or statement of recognition issued by the board
  2  6 of educational examiners and who have regular contact with
  2  7 students in kindergarten through grade twelve into the school
  2  8 district's comprehensive school improvement plan submitted
  2  9 pursuant to section 256.7, subsection 21. The content of
  2 10 the training shall be based on nationally recognized best
  2 11 practices.
  2 12    Sec. 3.  ADMINISTRATIVE RULES.  The state board of education
  2 13 shall submit a notice of intended action to the administrative
  2 14 rules coordinator and the administrative code editor pursuant
  2 15 to section 17A.4, subsection 1, not later than December 12,
  2 16 2018, for the adoption of rules required by section 256.7,
  2 17 subsection 33, as enacted by this Act. The board shall adopt
  2 18 such rules not later than July 1, 2019.
  2 19    Sec. 4.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
  2 20 3, shall not apply to this Act.
  2 21                           EXPLANATION
  2 22 The inclusion of this explanation does not constitute agreement with
  2 23 the explanation's substance by the members of the general assembly.
  2 24    This bill requires the board of directors of a school
  2 25 district to integrate annual, evidence=based training at
  2 26 least one hour in length on suicide prevention for all school
  2 27 personnel who hold a license, certificate, authorization, or
  2 28 statement of recognition issued by the board of educational
  2 29 examiners and who have regular contact with students in grades
  2 30 6 through 12 into the school district's comprehensive school
  2 31 improvement plan by July 1, 2019. The content of the training
  2 32 shall be based on nationally recognized best practices.
  2 33 The bill provides a similar requirement for training on
  2 34 trauma=informed care for school personnel who have regular
  2 35 contact with students in kindergarten through grade 12.
  3  1 The bill requires the department of education to adopt rules
  3  2 to require school districts to adopt protocols for suicide
  3  3 prevention and postvention and trauma=informed care based on
  3  4 nationally recognized best practices. The bill requires the
  3  5 board to submit a notice of intended action to begin such
  3  6 rulemaking no later than December 12, 2018, and to adopt such
  3  7 rules not later than July 1, 2019.
  3  8    The bill defines "trauma=informed care" as services that are
  3  9 based on an understanding of the vulnerabilities and triggers
  3 10 of individuals who have experienced trauma, recognize the role
  3 11 trauma has played in the lives of those individuals, recognize
  3 12 the presence and onset of trauma symptoms, are supportive of
  3 13 trauma recovery, and avoid further traumatization. The bill
  3 14 defines "postvention" as the provision of crisis intervention,
  3 15 support, and assistance for those affected by a suicide or
  3 16 suicide attempt to prevent further risk of suicide.
  3 17    The bill may include a state mandate as defined in Code
  3 18 section 25B.3.  The bill makes inapplicable Code section 25B.2,
  3 19 subsection 3, which would relieve a political subdivision from
  3 20 complying with a state mandate if funding for the cost of
  3 21 the state mandate is not provided or specified.  Therefore,
  3 22 political subdivisions are required to comply with any state
  3 23 mandate included in the bill.
