Section 148G.1, Code 2018, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 10A. "Sleep diagnostic testing facility" 1 4 means a building or place situated in a fixed location 1 5 or a mobile entity that is used to provide sleep=related 1 6 services and includes sleep=related disorder centers and 1 7 laboratories for sleep=related respiratory disorders, but 1 8 does not include a hospital licensed under chapter 135B that 1 9 provides sleep=related services for its patients, including 1 10 sleep=related services provided under arrangements made by 1 11 the hospital for its patients whereby the hospital exercises 1 12 professional responsibility over the arranged services. 1 13 Sec. 2. Section 148G.3, Code 2018, is amended to read as 1 14 follows: 1 15 148G.3 Location of services. 1 16 The practice of polysomnography shall take place only in a 1 17 facility that is accredited by a nationally recognized sleep 1 18 medicine laboratory or center accrediting agency, in a facility 1 19 operated by a hospital or a hospital licensed under chapter 1 20 135B, or in a patient's home, with testing equipment provided 1 21 by a sleep diagnostic testing facility, hospital licensed 1 22 under chapter 135B, or mobile testing company with a physical 1 23 location in the state of Iowa, pursuant to rules adopted by 1 24 the board; provided, however, that the scoring of data and the 1 25 education of patients may take place in another setting. 1 26 Sec. 3. NEW SECTION. 148G.3A Supervision of sleep=related 1 27 services in a patient's home. 1 28 Sleep=related services provided in a patient's home shall 1 29 be conducted under the general supervision of a physician 1 30 or qualified health care professional prescriber and the 1 31 results thereof shall be interpreted by a physician. Patients 1 32 shall be educated on the proper use of testing equipment 1 33 by a respiratory care practitioner, respiratory care and 1 34 polysomnography practitioner, registered polysomnographic 1 35 technologist, or physician employed by or affiliated with the 2 1 sleep diagnostic testing facility providing the sleep=related 2 2 services. 2 3 Sec. 4. NEW SECTION. 148G.3B Operation of sleep diagnostic 2 4 testing facilities. 2 5 A sleep diagnostic testing facility shall comply with all of 2 6 the following standards: 2 7 1. A sleep diagnostic testing facility shall be supervised 2 8 by a physician. 2 9 2. A sleep diagnostic testing facility shall be accredited 2 10 by a nationally recognized sleep medicine laboratory or center 2 11 accrediting agency. 2 12 3. Data from the provision of sleep=related services shall 2 13 be interpreted by a physician. 2 14 4. All sleep=related services shall be conducted by or under 2 15 the general supervision of a physician or qualified health care 2 16 professional prescriber. 2 17 EXPLANATION 2 18 The inclusion of this explanation does not constitute agreement with 2 19 the explanation's substance by the members of the general assembly. 2 20 This bill concerns the practice of polysomnography in Iowa. 2 21 The bill adds a requirement that any in=home sleep 2 22 diagnostic testing be performed with equipment provided by 2 23 a sleep diagnostic testing facility, hospital, or mobile 2 24 testing company with a physical location in Iowa and that the 2 25 patient receive education on the proper use of such equipment 2 26 by a respiratory care practitioner, respiratory care and 2 27 polysomnography practitioner, registered polysomnographic 2 28 technologist, or physician employed by or affiliated with the 2 29 sleep diagnostic testing facility. The bill also requires 2 30 that any sleep=related services provided in a patient's home 2 31 be performed under the general supervision of a physician or 2 32 qualified health care professional prescriber and data from the 2 33 provision of sleep=related services shall be interpreted by a 2 34 physician. 2 35 The bill requires a sleep diagnostic testing facility, 3 1 as defined in the bill, to be accredited by a nationally 3 2 recognized sleep medicine laboratory or center accrediting 3 3 agency.
