H.F. 2280 Section 1. Section 476.1B, subsection 1, paragraph e, Code 1 2014, is amended to read as follows: 2 e. Disconnection of service, as set forth in section 476.20 , 3 subsections 1 through 4 . 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to the regulatory authority of the Iowa 8 utilities board with regard to municipal utility disconnection 9 procedures. 10 Currently, Code section 476.1B provides that a municipally 11 owned utility is not subject to regulation by the Iowa 12 utilities board, subject to certain specified exceptions. One 13 such exception is with regard to disconnection of service, as 14 provided in Code section 476.20. 15 The bill modifies this reference to Code section 476.20 to 16 limit the applicability of board regulation to subsections 17 1 through 4 of the Code section. This renders provisions 18 contained in Code section 476.20, subsection 5, regarding the 19 board establishing rules relating to deposits which may be 20 required by a utility for the initiation or reinstatement of 21 service, inapplicable to municipal utilities. 22 -1- LSB 5647HV (2) 85 rn/nh 1/ 1
