  1  1    Section 1.  Section 461A.46, Code 2017, is amended to read
  1  2 as follows:
  1  3    461A.46  Closing time.
  1  4    1.  Except by arrangement or permission granted by the
  1  5 director or the director's authorized representative, all
  1  6 persons shall vacate state parks and preserves before 10:30
  1  7 p.m. Areas may be closed at an earlier or later hour, of which
  1  8 notice shall be given by proper signs or instructions.
  1  9    2.  Notwithstanding subsection 1, lake Macbride state park
  1 10 shall be closed at 8:30 p.m. and all persons shall vacate the
  1 11 park before that time.
  1 12    3.  The provisions of this section shall not apply to
  1 13 authorized camping in areas provided for that purpose.
  1 14    Sec. 2.  NEW SECTION.  461A.51A  Lake Macbride == alcohol
  1 15 prohibited.
  1 16    1.  A person shall not possess, use, or consume an alcoholic
  1 17 beverage, as defined in section 123.3, in lake Macbride state
  1 18 park.
  1 19    2.  A person violating this section is guilty of a simple
  1 20 misdemeanor punishable as a scheduled violation pursuant to
  1 21 section 805.8B, subsection 6, paragraph "c".
  1 22    Sec. 3.  Section 805.8B, subsection 6, paragraph c, Code
  1 23 2017, is amended to read as follows:
  1 24    c.  For violations of sections 461A.35, 461A.42, and 461A.44,
  1 25 and 461A.51A, the scheduled fine is fifty dollars.
  1 26                           EXPLANATION
  1 27 The inclusion of this explanation does not constitute agreement with
  1 28 the explanation's substance by the members of the general assembly.
  1 29    This bill regulates the closing time for and the possession,
  1 30 use, or consumption of alcoholic beverages in lake Macbride
  1 31 state park.
  1 32    The bill provides that lake Macbride state park shall be
  1 33 closed at 8:30 p.m. and all persons shall vacate the park
  1 34 before that time. Currently, the park closes at 10:30 p.m.
  1 35 This provision does not apply to authorized camping areas.
  2  1 A violation of this provision is punishable as a scheduled
  2  2 violation with a fine of $15.
  2  3    The bill also prohibits a person from possessing, using, or
  2  4 consuming an alcoholic beverage in lake Macbride state park.
  2  5 Currently, alcoholic beverages are prohibited by rule (IAC
  2  6 571=61.7(2)(e)) in lake Macbride state park only on beaches,
  2  7 and the prohibition does not apply to rental facilities located
  2  8 within the 200=foot buffer of land surrounding the sand or
  2  9 fenced=in area that have been officially reserved through the
  2 10 department of natural resources.  A person violating this
  2 11 provision is guilty of a simple misdemeanor punishable as a
  2 12 scheduled violation with a fine of $50.
