H.F. 2245 Section 1. Section 514C.34, subsection 3, Code 2022, is 1 amended to read as follows: 2 3. a. Health care services that are delivered by telehealth 3 must be appropriate and delivered in accordance with applicable 4 law and generally accepted health care practices and standards 5 prevailing at the time the health care services are provided, 6 including all rules adopted by the appropriate professional 7 licensing board, pursuant to chapter 147 , having oversight 8 of the health care professional providing the health care 9 services. 10 b. A health carrier shall not exclude a health care 11 professional who provides services for mental health 12 conditions, illnesses, injuries, or diseases and who is 13 physically located out-of-state from participating as a 14 provider, via telehealth, under a policy, plan, or contract 15 offered by the health carrier in the state if all of the 16 following requirements are met: 17 (1) The health care professional is licensed in this state 18 by the appropriate professional licensing board and is able 19 to deliver health care services for mental health conditions, 20 illnesses, injuries, or diseases via telehealth in compliance 21 with paragraph “a” . 22 (2) The health care professional is able to satisfy the same 23 criteria that the health carrier uses to qualify a health care 24 professional who is located in the state, and who holds the 25 same license as the out-of-state professional, to participate 26 as a provider, via telehealth, under a policy, plan, or 27 contract offered by the health carrier in the state. 28 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 29 importance, takes effect upon enactment. 30 Sec. 3. APPLICABILITY. This Act applies to health carriers 31 that deliver, issue for delivery, continue, or renew a policy, 32 contract, or plan in this state on or after the effective date 33 of this Act. 34 EXPLANATION 35 -1- LSB 5650HV (1) 89 ko/rn 1/ 2
H.F. 2245 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 This bill prohibits certain health carriers (carriers) 3 from excluding certain out-of-state health care professionals 4 (professionals) who provide services for mental health 5 conditions, illnesses, injuries, or diseases (mental health) 6 from participating as providers, via telehealth, under a 7 policy, plan, or contract offered by the health carrier if 8 the professional is licensed in Iowa, is able to deliver 9 health care services for mental health via telehealth in 10 compliance with Code chapter 514C.34, and is able to satisfy 11 the same criteria that the carrier uses to qualify in-state 12 professionals, who hold the same license as the out-of-state 13 professional, as providers. 14 The bill takes effect upon enactment and applies to carriers 15 that deliver, issue for delivery, continue, or renew a 16 policy, contract, or plan in this state on or after the bill’s 17 effective date. 18 -2- LSB 5650HV (1) 89 ko/rn 2/ 2
