  1  1    Section 1.  NEW SECTION.  70A.26A  Volunteer leave.
  1  2    An employee of an appointing authority may be granted leave
  1  3 with pay from work for not more than one hour in any work
  1  4 week to participate in volunteer activities at a nonprofit
  1  5 organization or school upon the approval of the employee's
  1  6 appointing authority without loss of seniority, pay, vacation
  1  7 time, personal days, sick leave, insurance and health coverage
  1  8 benefits, or earned overtime accumulation. The appointing
  1  9 authority shall compensate an employee granted leave under this
  1 10 section at the employee's regular rate of pay for those regular
  1 11 work hours during which the employee is absent from work. An
  1 12 employee deemed to be on leave under this section shall not be
  1 13 deemed to be an employee of the state for purposes of workers'
  1 14 compensation. An employee deemed to be on leave under this
  1 15 section shall not be deemed to be an employee of the state for
  1 16 purposes of the Iowa tort claims Act, chapter 669.
  1 17                           EXPLANATION
  1 18 The inclusion of this explanation does not constitute agreement with
  1 19 the explanation's substance by the members of the general assembly.
  1 20    This bill allows an employee of an appointing authority
  1 21 paid time off for not more than one hour in any work week to
  1 22 volunteer at a nonprofit organization or school upon approval
  1 23 of the employee's appointing authority.  The employee shall not
  1 24 lose any pay or benefits as a result of the paid leave and shall
  1 25 not be considered a state employee for workers' compensation or
  1 26 state tort claims Act purposes during the period of leave.
