Section 8.10, Code 2016, is amended by adding the 1 2 following new subsection: 1 3 NEW SUBSECTION. 9. Monitor compliance with the state grants 1 4 equitable distribution requirements established in section 1 5 8.12. 1 6 Sec. 2. NEW SECTION. 8.12 State grants ==== equitable 1 7 distribution requirements. 1 8 1. In addition to the function of developing and 1 9 administering a system to track, identify, advocate for, and 1 10 coordinate nonstate grants as provided in section 8.9, the 1 11 office shall develop and administer a system for monitoring 1 12 compliance with the state grants equitable distribution 1 13 requirements specified in subsection 2. 1 14 2. a. To the extent possible and consistent with the 1 15 objective, nature, and scope of a particular grant, each 1 16 state agency, as defined in section 8.11, that administers a 1 17 nonfederal, discretionary state grant program or fund shall 1 18 ensure that grants are distributed equitably on the basis 1 19 of population across the state. An equitable distribution 1 20 shall be considered to be achieved by distributing grant funds 1 21 equally per state congressional district over the course of 1 22 an ongoing three=year period. Grant programs which by their 1 23 nature are restricted to or focused on a more localized scope 1 24 of distribution shall be exempt from this requirement. 1 25 b. The facilitator shall develop a system for obtaining and 1 26 tracking state agency reporting on an annual basis regarding 1 27 the extent to which an equitable distribution has been achieved 1 28 for grant programs to which the equitable distribution 1 29 requirements are applicable. The facilitator shall submit a 1 30 report by January 1 annually to the general assembly regarding 1 31 compliance with the requirements. 1 32 Sec. 3. STATE GRANTS EQUITABLE DISTRIBUTION STUDY. The 1 33 office of grants enterprise management established in section 1 34 8.9 shall conduct a study regarding the extent to which 1 35 nonfederal, discretionary state grants have been distributed 2 1 equitably from the standpoint of population across the state. 2 2 The study shall analyze the distribution of grant funds for 2 3 grant programs which by their nature have been or could have 2 4 been distributed partially or completely statewide over the 2 5 preceding ten=year period. The office shall complete the study 2 6 and submit a report to the general assembly by January 1, 2017. 2 7 EXPLANATION 2 8 The inclusion of this explanation does not constitute agreement with 2 9 the explanation's substance by the members of the general assembly. 2 10 This bill establishes state grant equitable distribution 2 11 requirements and requires a state grant equitable distribution 2 12 study to be conducted. 2 13 The bill provides that in addition to its functions relating 2 14 to nonstate grants, the office of enterprise management shall 2 15 develop and administer a system for monitoring compliance with 2 16 state grant equitable distribution requirements. 2 17 The bill provides that to the extent possible and consistent 2 18 with the objective, nature, and scope of a particular grant, 2 19 each state agency that administers a nonfederal, discretionary 2 20 state grant program or fund shall ensure that grants are 2 21 distributed equitably on the basis of population across the 2 22 state. An equitable distribution shall be considered to 2 23 be achieved by distributing grant funds equally per state 2 24 congressional district over the course of an ongoing three=year 2 25 period.
