  1  1    Section 1.  NEW SECTION.  321.200B  Felony convictions.
  1  2    1.  Upon receiving a person's application for issuance or
  1  3 renewal of a driver's license, the department shall conduct a
  1  4 state criminal history background check and national criminal
  1  5 history check of the person to determine whether the person has
  1  6 been convicted of a felony. If the person has been convicted
  1  7 of a felony, the department shall indicate that the person
  1  8 has been convicted of a felony to a peace officer or employee
  1  9 of a law enforcement agency at the time the peace officer
  1 10 or employee of a law enforcement agency requests from the
  1 11 department the person's driver's license record or operating
  1 12 record as part of a traffic stop of a motor vehicle involving
  1 13 the person.
  1 14    2.  Notwithstanding section 321.10, 321.11, 321.11A,
  1 15 or any other provision of law to the contrary, information
  1 16 collected pursuant to this section shall not be made available
  1 17 to the public or to any person other than to a peace officer
  1 18 or employee of a law enforcement agency requesting from the
  1 19 department a person's driver's license record or operating
  1 20 record as part of a traffic stop of a motor vehicle involving
  1 21 the person.
  1 22    3.  The department shall adopt rules as necessary for the
  1 23 administration of this section.
  1 24    Sec. 2.  APPLICABILITY.  This Act applies to applications
  1 25 for issuance or renewal of a driver's license received by the
  1 26 department of transportation on or after July 1, 2018.
  1 27                           EXPLANATION
  1 28 The inclusion of this explanation does not constitute agreement with
  1 29 the explanation's substance by the members of the general assembly.
  1 30    This bill requires the department of transportation (DOT),
  1 31 upon receiving a person's application for issuance or renewal
  1 32 of a driver's license, to conduct a state criminal history
  1 33 background check and national criminal history check of the
  1 34 person to determine whether the person has been convicted of a
  1 35 felony. If the person has been convicted of a felony, the bill
  2  1 requires the DOT to indicate that the person has been convicted
  2  2 of a felony to a peace officer or employee of a law enforcement
  2  3 agency at the time the peace officer or employee of a law
  2  4 enforcement agency requests from the DOT the person's driver's
  2  5 license record or operating record as part of a traffic stop
  2  6 of a motor vehicle involving the person. The information
  2  7 collected under the bill is prohibited from being made
  2  8 available to the public or to any person other than a peace
  2  9 officer or employee of a law enforcement agency requesting from
  2 10 the DOT a person's driver's license record or operating record
  2 11 as part of a traffic stop of a motor vehicle involving the
  2 12 person. The bill requires the DOT to adopt rules as necessary.
  2 13 The bill applies to applications for issuance or renewal of a
  2 14 driver's license received by the DOT on or after July 1, 2018.
