1.
Section
49.21,
subsection
2,
Code
2024,
is
1
amended
by
adding
the
following
new
paragraph:

NEW
PARAGRAPH
.
c.
The
commissioner
shall
not
select

a
school
as
a
polling
place
unless
the
commissioner
first
4
determines
that
no
other
buildings
or
grounds
supported
5
by
taxation
under
the
laws
of
this
state
or
otherwise
made
6
available
for
use
as
a
polling
place
without
charge
satisfy
the
7
requirements
of
this
section.

Sec.
2.
Section
49.24,
Code
2024,
is
amended
to
read
as
9
follows:

49.24
Schoolhouses
as
polling
places.
11
In
precincts
outside
of
cities
the
election
shall,
if
12
practicable
and
consistent
with
section
49.21
,
be
held
in
13
a
public
school
building.
Any
damage
to
the
building
or
14
furniture
resulting
from
the
election
shall
be
paid
by
the
15
county.

the

members
of
the
general
assembly.

This
bill
prohibits
a
county
commissioner
of
elections
from

selecting
a
school
as
a
polling
place
unless
the
commissioner

first
determines
that
no
other
buildings
or
grounds
supported

by
taxation
under
the
laws
of
this
state
or
that
would
23
otherwise
be
made
available
for
use
as
a
polling
place
without
24
charge
would
satisfy
the
requirements
of
Code
section
49.21
