  1 An Act prohibiting the purchase of weapons seized as a public
  2    nuisance by certain persons.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 483A.33, Code 2018, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  6.  The director, any peace officer,  an
  1  4 employee of the department, or a member of the immediate family
  1  5 of the director, peace officer, or employee shall not purchase
  1  6 a weapon seized pursuant to section 483A.32 and disposed of
  1  7 pursuant to this section or section 809.21.  For purposes
  1  8 of this subsection, "member of the immediate family" means a
  1  9 spouse, child, stepchild, brother, brother=in=law, stepbrother,
  1 10 sister, sister=in=law, stepsister, parent, parent=in=law, or
  1 11 stepparent of the director, a peace officer, or an employee of
  1 12 the department who resides in the same household in the same
  1 13 principal residence of the director, a peace officer, or an
  1 14 employee of the department.
  1 15                           EXPLANATION
  1 16 The inclusion of this explanation does not constitute agreement with
  1 17 the explanation's substance by the members of the general assembly.
  1 18    This bill prohibits the director, any peace officer, and
  1 19 any employee of the department of natural resources and any
  1 20 immediate family member of the director, a peace officer,
  1 21 or an employee from purchasing a weapon seized as a public
  1 22 nuisance incident to a violation of specified statutes
  1 23 and rules pertaining to wildlife laws and sold at a public
  1 24 sale or auction by the department of natural resources or
  1 25 the department of public safety. Legal weapons, including
  1 26 rifles and shotguns, seized in this manner are disposed of,
  1 27 as provided by rule, by the department at its annual public
  1 28 sale. Other legal weapons seized may be sold by the department
  1 29 of public safety at public auction pursuant to Code section
  1 30 809.21.
