  1  1    Section 1.  Section 22.7, subsection 9, Code 2018, is amended
  1  2 to read as follows:
  1  3    9.  Criminal identification files of law enforcement
  1  4 agencies. However, records of current and prior arrests,
  1  5 immigration status information, and criminal history data shall
  1  6 be public records.
  1  7                           EXPLANATION
  1  8 The inclusion of this explanation does not constitute agreement with
  1  9 the explanation's substance by the members of the general assembly.
  1 10    This bill relates to criminal identification files of
  1 11 law enforcement agencies and immigration status information.
  1 12 Currently, criminal identification files of law enforcement
  1 13 agencies are confidential records, except for records
  1 14 of current and prior arrests, and criminal history data.
  1 15 "Criminal history data" is defined in Code section 692.1(5).
  1 16 Under Code section 22.7, confidential records may be released
  1 17 by court order, the lawful custodian of the records, or by
  1 18 another person authorized to release such records.
  1 19    The bill makes immigration status contained in a criminal
  1 20 identification file of a law enforcement agency a public
  1 21 record. A person has the right to examine a public record
  1 22 pursuant to Code section 22.2.
