  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 910.3B, Code 2018, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  4.  An award under this section shall not
  1  4 be reduced by any third=party payment including any insurance
  1  5 payment made to the victim's estate or heirs at law.
  1  6                           EXPLANATION
  1  7 The inclusion of this explanation does not constitute agreement with
  1  8 the explanation's substance by the members of the general assembly.
  1  9    This bill relates to restitution paid to the estate or heirs
  1 10 at law of a crime victim.
  1 11    The bill provides that restitution awarded under Code
  1 12 section 910.3B, after an offender causes the death of another,
  1 13 shall not be reduced by any third=party payment including any
  1 14 insurance payment made to the victim's estate or heirs at law.
  1 15    Currently, restitution awarded under Code section 910.3B
  1 16 shall not be an amount less than $150,000.
