Section 360.3, Code 2016, is amended to read as 1 2 follows: 1 3 360.3 Transfer of fund. 1 4 When there are fundsinunder thehandscontrol of a township 1 5 clerk, raised under this chapter which are not desired for the 1 6 purposes for which they were raised, thefundstrustees may, 1 7 by majority vote, order that the funds be transferred to the 1 8 general fund of a school district or districts pro rata in 1 9 which the funds were raised, when a petition is presented to 1 10 the trustees, signed by a majority of the registered voters of 1 11 the township, as shown by the election register or registers 1 12 of the last preceding primary or general election held in the 1 13 township. The transfer of funds shall be made by the township 1 14 clerk upon order of the trusteesafter the filing of the 1 15 petition with the clerk. 1 16 EXPLANATION 1 17 The inclusion of this explanation does not constitute agreement with 1 18 the explanation's substance by the members of the general assembly. 1 19 This bill relates to requirements for the transfer of 1 20 township funds collected for purposes of purchasing or 1 21 lease=purchasing a public hall. Under current law, public hall 1 22 funds that are not needed for purposes of acquiring a public 1 23 hall may be transferred by order of the trustees to the general 1 24 funds of the school districts where the funds were raised upon 1 25 receipt of a petition presented by registered voters of the 1 26 township. Under the bill, such funds may be transferred to 1 27 school district general funds by order of the trustees upon a 1 28 majority vote of the township trustees. LSB 5499YH (2) 86 aw/sc
