Section 217.41B, subsection 3, Code 2018, is 1 2 amended to read as follows: 1 3 3.a. (1) Distribution of family planning services program 1 4 funds shall not be made to any entity that performs abortions 1 5 or that maintains or operates a facility where abortions 1 6 are performed, which shall not be interpreted to include a 1 7 nonpublic entity that is a distinct location of a nonprofit 1 8 health care delivery system, if the distinct location provides 1 9 family planning services but does not perform abortions 1 10 or maintain or operate as a facility where abortions are 1 11 performed. 1 12 (2) The department of human services shall adopt rules 1 13 pursuant to chapter 17A to require that as a condition of 1 14 eligibility as a provider under the family planning services 1 15 program, each distinct location of a nonprofit health care 1 16 delivery system shall enroll in the program as a separate 1 17 provider, be assigned a distinct provider identification 1 18 number, and complete an attestation that abortions are not 1 19 performed at the distinct location. 1 20 (3) For the purposes of this section, "nonprofit health 1 21 care delivery system" means an Iowa nonprofit corporation 1 22 that controls, directly or indirectly, a regional health 1 23 care network consisting of hospital facilities and various 1 24 ambulatory and clinic locations that provide a range of 1 25 primary, secondary, and tertiary inpatient, outpatient, and 1 26 physician services. 1 27 b. For the purposes of this section, "abortion" does not 1 28 include any of the following: 1 29a.(1) The treatment of a woman for a physical 1 30 disorder, physical injury, or physical illness, including a 1 31 life=endangering physical condition caused by or arising from 1 32 the pregnancy itself, that would, as certified by a physician, 1 33 place the woman in danger of death. 1 34b.(2) The treatment of a woman for a spontaneous abortion, 1 35 commonly known as a miscarriage, when not all of the products 2 1 of human conception are expelled. 2 2 EXPLANATION 2 3 The inclusion of this explanation does not constitute agreement with 2 4 the explanation's substance by the members of the general assembly. 2 5 This bill provides for the participation of certain 2 6 providers in the state family planning services program. Under 2 7 the state family planning services program, distribution of 2 8 family planning services program funds are prohibited from 2 9 being made to any entity that performs abortions or that 2 10 maintains or operates a facility where abortions are performed. 2 11 The bill provides that any entity that performs abortions or 2 12 that maintains or operates a facility where abortions are 2 13 performed is not to be interpreted to include a nonpublic 2 14 entity that is a distinct location of a nonprofit health care 2 15 delivery system, if the distinct location provides family 2 16 planning services but does not perform abortions or maintain 2 17 or operate as a facility where abortions are performed. The 2 18 bill directs the department of human services to adopt rules 2 19 pursuant to Code chapter 17A to require that as a condition of 2 20 eligibility as a provider under the family planning services 2 21 program, each distinct location of a nonprofit health care 2 22 delivery system shall enroll in the program as a separate 2 23 provider, be assigned a distinct provider identification 2 24 number, and complete an attestation regarding non=provision 2 25 of abortions at the distinct location. The bill defines 2 26 "nonprofit health care delivery system" as an Iowa nonprofit 2 27 corporation that controls, directly or indirectly, a regional 2 28 health care network consisting of hospital facilities and 2 29 various ambulatory and clinic locations that provide a range 2 30 of primary, secondary, and tertiary inpatient, outpatient, and 2 31 physician services.
