  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 400.20, Code 2018, is amended to read as
  1  2 follows:
  1  3    400.20  Appeal.
  1  4    The removal, discharge, demotion, or suspension of a person
  1  5 holding civil service rights may be appealed to the civil
  1  6 service commission within fourteen calendar days after the
  1  7 removal, discharge, demotion, or suspension.  The person shall
  1  8 have an additional thirty days to appeal if the circumstances
  1  9 relating to the removal, discharge, demotion, or  suspension
  1 10 involve conduct by a supervisor or other employee of the
  1 11 person's department that results in a conviction of a crime by
  1 12 a guilty plea, deferred judgment, or other finding of guilt by
  1 13 a court of competent jurisdiction. 
  1 14                           EXPLANATION
  1 15 The inclusion of this explanation does not constitute agreement with
  1 16 the explanation's substance by the members of the general assembly.
  1 17    This bill provides a person an additional 30 days to appeal
  1 18 a removal, discharge, demotion, or  suspension to a city
  1 19 civil service commission if the circumstances relating to the
  1 20 removal, discharge, demotion, or  suspension involve conduct by
  1 21 a supervisor or other employee of the person's department that
  1 22 results in a conviction of a crime by a guilty plea, deferred
  1 23 judgment, or other finding of guilt by a court of competent
  1 24 jurisdiction. Under current law, a person has 14 days after
  1 25 the  removal, discharge, demotion, or  suspension to make an
  1 26 appeal.
