  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 34A.7A, subsection 2, Code 2015, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  0b.  (1)  The program manager shall allocate
  1  4 to each joint E911 service board and to the department of
  1  5 public safety a minimum of one thousand dollars per calendar
  1  6 quarter for each public safety answering point within the
  1  7 service area of the department of public safety or joint E911
  1  8 service board that has submitted an annual written request to
  1  9 the program manager in a form approved by the program manager
  1 10 by May 15 of each year.
  1 11    (2)  The amount allocated under this paragraph "0b" shall be
  1 12 eighty=three percent of the total amount of surcharge generated
  1 13 per calendar quarter allocated as follows:
  1 14    (a)  Sixty=five percent of the total dollars available for
  1 15 allocation shall be allocated in proportion to the square miles
  1 16 of the service area to the total square miles in this state.
  1 17    (b)  Thirty=five percent of the total dollars available for
  1 18 allocation shall be allocated in proportion to the wireless
  1 19 E911 calls taken at the public safety answering point in
  1 20 the service area to the total number of wireless E911 calls
  1 21 originating in this state.
  1 22    (c)  Notwithstanding subparagraph divisions (a) and (b), the
  1 23 minimum amount allocated to each joint E911 service board and
  1 24 to the department of public safety shall be no less than one
  1 25 thousand dollars for each public safety answering point within
  1 26 the service area of the department of public safety or joint
  1 27 E911 service board.
  1 28    (3)  The funds allocated in this paragraph "0b" shall be
  1 29 used for communication equipment utilized for the receipt and
  1 30 disposition of 911 calls.
  1 31    Sec. 2.  Section 34A.7A, subsection 2, paragraph e, Code
  1 32 2015, is amended by striking the paragraph.
  1 33    Sec. 3.  Section 34A.7A, subsection 2, paragraph f, Code
  1 34 2015, is amended to read as follows:
  1 35    f.  If moneys remain in the fund after fully paying all
  2  1 obligations under paragraphs "a", "0b", "b", "c", and "d", and
  2  2 "e", the remainder may be accumulated in the fund as a carryover
  2  3 operating surplus. This The program manager, in consultation
  2  4 with the E911 communications council, shall allocate an amount,
  2  5 not to exceed one hundred thousand dollars per fiscal year,
  2  6 for development of public awareness and educational programs
  2  7 related to the use of 911 by the public, educational programs
  2  8 for personnel responsible for the maintenance, operation,
  2  9 and upgrading of local E911 systems, and the expenses of
  2 10 members of the E911 communications council for travel,
  2 11 monthly meetings, and training.  The remaining surplus shall
  2 12 be used to fund future network and public safety answering
  2 13 point improvements, including hardware and software for an
  2 14 internet protocol=enabled next generation network, and wireless
  2 15 carriers' transport costs related to wireless E911 services, if
  2 16 those costs are not otherwise recovered by wireless carriers
  2 17 through customer billing or other sources and approved by the
  2 18 program manager in consultation with the E911 communications
  2 19 council. Notwithstanding section 8.33, any moneys remaining
  2 20 in the fund at the end of each fiscal year shall not revert to
  2 21 the general fund of the state but shall remain available for
  2 22 the purposes of the fund.
  2 23                           EXPLANATION
  2 24 The inclusion of this explanation does not constitute agreement with
  2 25 the explanation's substance by the members of the general assembly.
  2 26    This bill relates to the expenditure of moneys in the E911
  2 27 emergency communications fund.  The bill reprioritizes the
  2 28 expenditures from the fund by moving the allocations to the
  2 29 joint E911 service board and to the department of public safety
  2 30 from fifth in the list of priority to second in the list of
  2 31 priority after the amount appropriated to the director of the
  2 32 department of homeland security and emergency management and
  2 33 program manager for implementation, support, and maintenance of
  2 34 the functions of the director and program manager.  The bill
  2 35 also increases the percentage allocated from the total amount
  3  1 of surcharge generated per calendar quarter from 46 percent to
  3  2 83 percent.  The bill also adds that from any surplus in the
  3  3 E911 emergency communications fund remaining after payment of
  3  4 the priorities, the E911 program manager, in consultation with
  3  5 the E911 communications council, shall allocate an amount not
  3  6 to exceed $100,000 per fiscal year for development of public
  3  7 awareness and educational programs for the public, educational
  3  8 programs for personnel responsible for maintenance, operation,
  3  9 and upgrading of E911 systems, and for the expenses of members
  3 10 of the E911 communications council for travel, monthly
  3 11 meetings, and training.
