House File 155 - Introduced HOUSE FILE BY BYRNES A BILL FOR 1 An Act relating to the operation of a motor vehicle in the far 2 left lane of a divided, multilaned highway at a speed under 3 the posted speed limit, and providing a penalty. 4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1781YH (3) 86 ns/nh PAG LIN 1 1 Section 1. Section 321.297, Code 2015, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 2A. a. A person operating a motor vehicle 1 4 in the far left lane of a divided, multilaned highway shall not 1 5 operate the vehicle at a speed of ten miles per hour or more 1 6 under the posted speed limit if the person knows or reasonably 1 7 should know that the operator of another motor vehicle in the 1 8 far left lane traveling in the same direction as the person is 1 9 attempting to overtake the person from the rear at a higher 1 10 rate of speed. 1 11 b. This subsection shall not apply if the person is 1 12 attempting to overtake the operator of another motor vehicle 1 13 traveling in the same direction as the person or if the person 1 14 is preparing to make a left turn. 1 15 EXPLANATION 1 16 The inclusion of this explanation does not constitute agreement with 1 17 the explanation's substance by the members of the general assembly. 1 18 This bill prohibits a person operating a motor vehicle 1 19 in the far left lane of a divided, multilaned highway from 1 20 driving at a speed of 10 miles per hour or more under the 1 21 posted speed limit if the person knows or reasonably should 1 22 know that another driver in the far left lane traveling in the 1 23 same direction as the person is attempting to overtake the 1 24 person from the rear at a higher rate of speed. The bill does 1 25 not apply to a person attempting to overtake another driver 1 26 traveling in the same direction as the person or to a person 1 27 preparing to make a left turn. 1 28 Current law provides a scheduled fine for a violation of this 1 29 section of $100.
