  1  1    Section 1.  NEW SECTION.  249A.38A  Financial institutions ==
  1  2 request for records == penalty.
  1  3    1.  Upon written request signed by an authorized employee or
  1  4 agent of the department, a financial institution shall provide,
  1  5 without charge, the deposit and withdrawal records from the
  1  6 preceding five years for an applicant for or recipient of
  1  7 medical assistance to any authorized employee or agent of the
  1  8 department or to the applicant or recipient.
  1  9    2.  The department shall develop and make available an easily
  1 10 downloadable request form bearing an electronic signature of an
  1 11 authorized employee or agent of the department to be used by an
  1 12 applicant or recipient in requesting the records specified in
  1 13 this section.
  1 14    3.  A financial institution that unreasonably refuses to
  1 15 provide the records specified in this section within the time
  1 16 limit provided in the request or that willfully provides false
  1 17 information in the response to the request shall be assessed a
  1 18 civil penalty of not more than fifty dollars.
  1 19    4.  For the purposes of this section, "financial institution"
  1 20 means financial institution as defined in section 252I.1.
  1 21                           EXPLANATION
  1 22 The inclusion of this explanation does not constitute agreement with
  1 23 the explanation's substance by the members of the general assembly.
  1 24    This bill requires that upon written request signed by
  1 25 an authorized employee or agent of the department of human
  1 26 services (DHS), a financial institution shall provide, without
  1 27 charge, the deposit and withdrawal records from the preceding
  1 28 five years for an applicant for or recipient of Medicaid to
  1 29 any authorized employee or agent of DHS or to the applicant
  1 30 or recipient. The bill directs DHS to develop and make
  1 31 available an easily downloadable request form bearing an
  1 32 electronic signature of an authorized employee or agent of
  1 33 DHS to be used by an applicant or recipient in requesting the
  1 34 records specified in the bill.   A financial institution that
  1 35 unreasonably refuses to provide the records specified within
  2  1 the time limit provided in the request or that willfully
  2  2 provides false information in the response to the request shall
  2  3 be assessed a civil penalty of not more than $50.
